Dear Sir or Madam,

I understand that there are a number of accusations of the
University of East Anglia - specifically the Climatic Research Unit
- have sought to evade their responsibilities under the freedom of
information act.

Can you tell me of any complaints that you have received, any
investigations (complete or in progress) that you have/are
undertaking?

If there were to be no investigation in progress regarding the
current claims (regarding the withholding of raw data regarding
historic climatic temperatures, and the destruction of emails and
the destruction of historic data), can you tell me what is required
for you to start such an investigation? Do you need a specific
complain from an individual? if so does the individual have to have
been the person who was denied information?

Dear Mr Perrin

I write with reference to your request for information dated 30 November
2009 concerning the University of East Anglia and further to our
acknowledgement letter.  As you are aware your request has been dealt
with under the Freedom of Information Act 2000. 

Your request asked for the number of complaints received by this office
concerning the Climatic Research Unit at the University of East Anglia. To
date we have received two allegations of a breach of the Freedom of
Information Act 2000 and one allegation of a breach of the Data Protection
Act 1998.  Our investigations into these complaints are ongoing.

Complaints made to this office as the regulator of the Freedom of
information Act 2000 are made under Section 50(1) of the Act.  This
states that:

“Any person (in this section referred to as “the complainant”) may
apply to the Commissioner for a decision whether, in any specified
respect, a request for information made by the complainant to a public
authority has been dealt with in accordance with the requirement of Part
1”

Therefore, in order to investigate a specific complaint concerning a
particular request for information, this would need to be brought by the
individual who made the request.   There, if further information about

We also monitor compliance with the Act proactively and have published our
enforcement strategy.

In this case our investigation stemmed from both individual complaints and
media interest.

Your request for internal review should be submitted to us within 40

handler under the legislation.  To make such an application, please write
