John Fletcher made this Freedom of Information request to Ministry of Justice

From: John Fletcher

Dear Ministry of Justice,
Please provide me with copies of all correspondence or
documentation held within your department which references ACS:Law
subsequent to June 2008 on file (electronically, including emails
or on paper, including letters). I am especially interested in any
correspondence with the Solicitors Regulation Authority, Office of
the Legal Services Ombudsman and Members of Parliament or the House
of Lords.
I accept that some of the information released may need to be
suitably redacted to comply with the Data Protection Act by
removing names, addresses and other specific personal information.
I am also interested in any action taken by employees within your
department (including ministers) with relation to the concerns
raised in the press about innocent individuals being caught up in a
systematic campaign by the aforementioned firm to pursue claims in
a bullying manner (in my opinion). There is a strong public
interest in the release of this data as figures from BBC news
indicate that 15,000 new people were to be in receipt of letters
from this firm in the early months of the year.
Finally I am interested in the action taken by the Ministry of
Justice to improve the complaint response times of the SRA. A
previous Freedom of Information Act request made by myself has
uncovered that over half of complaints against Davenport Lyons were
resolved over a year after being filed. Further, a large number of
complaints against ACS:Law are also likely to pass 12 months with
no visible update in July of this year. The SRA seems unconcerned
about the poor timeliness of the complaints, and whilst it is
necessary to undertake a thorough investigation 12 months seems an
extraordinarily long period in which to do so.
Yours faithfully,
John Fletcher

Dear Keysell, David,
As the case against Davenport Lyons has been closed by the SRA, I
am happy to narrow my request to the ACS:Law investigation only.
I am also happy to narrow the timeline of my request from June 2008
to June 2009 onwards for documents held.
If necessary to further reduce cost I will accept a physical
document search from September 2009 onwards, (with the proviso
electronic records and documents are provided back to June 2009).
I believe that a public interest test would find disclosure beyond
the financial limit to have a strong case and therefore further
narrowing (even if above cost guidelines) will not be necessary.
Yours sincerely,
John Fletcher

11-JUN-10 Our Ref:FOI/65669/10
Dear John Fletcher,
SUBJECT: Freedom of Information Request
Thank you for your correspondence of June 10, 2010, in which you asked
for information regarding ACS:Law investigation only (clarification from your
previous request 65153) under the Freedom of Information Act 2000 (FOIA) from the
Ministry of Justice (MoJ).
You will receive a response from us by July 8, 2010. Your request has been passed
to the appropriate business unit within the MoJ, and they will write to you with
their decision by this date.
The FOIA does provide a number of exemptions. A qualified exemption requires that
before relying on it we must consider the public interest test. If the
information you have requested is covered by a qualified exemption(s) under FOIA,
the Department is allowed to take longer than 20 working days to respond. This is
because in such circumstances we are required to consider the public interest
issues when deciding whether or not to disclose the information requested.
If more time is needed to consider the public interest issues under a qualified
exemption(s), we will write to you and inform you of the revised date you can
expect to receive a response to your request.
If you have any queries regarding this request please do not hesitate to contact
us. Please quote ref: FOI/65669/10 in all future correspondence.
Yours sincerely,
David Keysell
