ACPO ‘guidance that ACPO Central Referral Unit’ to Northumbria Police, PSNI and Others - Martin McGartland

Dear Association of Chief Police Officers,

The CPS have written a letter dated 9th Sept 2011,link here:

and within their letter they included the following;

“On 12.1.11 Our Counter Terrorism Division contacted a
Superintendent at Northumbria Police who confirmed that for the
last four months they have been inundated with related FOI requests
and so had the PSNI. Accordingly, they had received guidance from
the ACPO Central Referral Unit.”

Under the freedom of information act can you please supply me with
all correspondence, information and documents relating to this
matter. Please also include full details, including copies of all
advice or ‘guidance that ACPO Central Referral Unit’ sent to
Northumbria Police relating to this matter, including copies of all
correspondence between NP (it officers/staff and ACPO (its
officers/staff) relating to this matter and or concerning my FOI
requests to NP, PSNO or any other forces or third parties. .

I must add that the comments by the CPS within their letter
concerning; ‘... a Superintendent at Northumbria Police who
confirmed that for the last four months they have been inundated
with related FOI requests and so had the PSNI.’

There are going to be requests made when NP refuse to answer FOI
request/s, when NP and its officers act corruptly , when NP collude
with others, when NP cover-up, when NP break the Law and when NP
continually lie, when NP do not answer my questions (as the victim,
when NP refuse to update me as the victim, as they are required to
do by law etc etc. This is what Sue Sim, Chris Thomson and many
other bent cops within NP have been doing. That is what they have
done, what they continue to do when dealing with me, my attempted
murder case. Moreover, the fact of the matter is that NP have never
released any of the information I have been requesting or asked
for, what NP have done is lied and claimed that my requests have
been or were 'vexatious' when the truth is they themselves were
saying this to cover-up their own wrongdoing and serious corruption
in my case. They continue to do so even to this day.

Dear The Association of Chief Police Officers of England, Wales and
Northern Ireland,

I am not requesting a review at this stage. I am seeking your help
and also further details, answers to questions and also an
explanation as follows;

1. Why have ACPO kept me waiting so long if they are now claiming
that this is not a FOIA request? I am now requesting a full
explanation.

2. You say in your reply that; "As has been outlined to you before,
any requests for this type of information are not covered by the
Freedom of
Information Act, but the Data Protection Act, which is outside of
my remit." Please explain when and how this was 'outlined' to me
'before', By whom and how was this done?

3. Are ACPO saying that none of the information I have requested is
available under the FOIA?

In your reply of today you did not deal with the above i.e. "Please

Can you please supply me with an answer to a very simple question.
It was you who made the above statement. Did ACPO make it up. Is
this yet another misleading statement? I would like an answer.

Please also confirm that you are now dealing with all of my above
correspondence, that you are also dealing with my request for a
Internal Review.

When I last spoke with ACPO by telephone I was told that they would
be releasing details to me of the third parties that they have had
dealings with concerning my requests. However, theyu have not done
so. Can they explain why this information has not be released?

You have delayed this request, you have failed to supply me with
help and further information that I requested, you have also been
ignoring my correspondence. What have ACPO got to hide? Answer:
Alot.

This is a request for an Internal Review. If ACPO have not dealt
with it within the 20 working day limit I can confirm I will be
making a complaint to the ICO.

Sue Sim and Northumbria Police said FOI request relating to Martin McGartland attempted murder case was 'Vexatious'. The Information Commissioner has issued a Decision Notice against Sue Sim and Northumbria Police which states, 'The Commissioner
finds that the force incorrectly applied section 14(1) to the request. He requires the public authority to respond to the request in accordance with the provisions of section 1 of the Act within 35
