Dear Highways Agency,
Please pass this on to the person who conducts Freedom of
Information reviews.
I am writing to request an internal review of Highways Agency's
handling of my FOI request 'Access road to new Evesham United FC
ground'.
It seems to me that the public interest tests regarding disclosure
have not been correctly applied. In particular:
"Breach of Confidentiality".
It would be possible to supply the aggregated costings themselves
without revealing the identity of the organisation which was their
source.
"Competition Issues [...] Releasing proposed costs would breach
current tender processes and give other potential bidders an unfair
advantage in preparing their current or future bids".
The headline cost of the scheme is already public knowledge. Any
potential bidder, therefore, already knows the price they have to
beat in order to be competitive.
"Commercially Sensitive Information [...] that difference may also
relate to quality or specification".
I am not interested in aspects of quality, merely of cost. It would
be possible to fulfil my request with this information redacted.
"Business Confidence: Disclosure of tender pricing given in
confidence may affect the likelihood of other developers being
willing to engage with the public sector"
As above. The headline costs have already been disclosed.
"Timing: [...] any information released now would be out of date".
This is irrelevant. My request relates to the information currently
held, not to information which may be held in the future. Whether
the information is useful or not is entirely my concern, not yours.
