FREEDOM OF INFORMATION REQUESTS REFERENCE NOs: RFI 2269 and RFI 2277
I write in connection with your three requests for information which were
received in December 2009. Please find below the responses to your
requests 2269 and 2277. FOI request RFI 2287 has already been forwarded
under separate cover:
FOI Request 2269
1.Please can I have the number of all arrests relating to offences in
Hagley made by Hagley and Rural Police in the past two years from the date
of this request
2. For each arrest please state the charge, a brief description of the
reason for arrest, time/date of arrest and whether the person was
subsequently charged or released.
REPLY: Please see the attached table
Please note that the arrests made would have been carried out by a variety
of officers i.e. Response, Other Local Policing teams etc. We are unable
to identify whether they were part of the Hagley Local Policing team. Also
due the length of time this request relates too, there will have been
significant movement of officers between teams.
Please also note that arrest records that do not have full address details
would not have been identified as Hagley and would not have been included
Every effort has been made to ensure that the information provided by our
North Worcestershire Division is as accurate and comprehensive as possible
FOI Request 2277
1. What is West Mercia Police policy (or national police policy) for
driving on/off and parking on pavements
REPLY: No recorded information held. West Mercia Police do not have a
current policy regarding driving on/off and parking on pavements and there
is no national police policy
2. Is it correct that the police have no powers to do anything about
persons driving onto/parking on pavements unless they actually witness it
REPLY: As in any allegation of an offence it is necessary to have evidence
which must be credible. Before we can prosecute someone there must be
cogent evidence. If the vehicle is in situ and is causing an obstruction
and police are called then the Police Officer can provide the evidence.
If a member of the public reports the vehicle but it has gone before
Police arrive, then the Police would take the evidence of the member of
the public who must be prepared to make a statement and attend Court if
necessary.
Similarly, somebody would have to witness the actual driving on the
pavement - it doesn't have to be a police officer - i.e., if a member of
the public witnessed it and wanted to report it then again they would need
to make a statement to the Police in enough detail that the Police could
trace the vehicle and speak to/report the driver.
3. Why is such an occurrence a problem for Hagley Police?
REPLY: Please be advised that this is not a valid Freedom of information
Act request as it does not fulfil Section 8 of the Act. It is not a
request for specific recorded information
4. Please state what law and the section of legislation that states that
police must see the offence of driving onto a pavement themselves, to
enable them to act
REPLY: Not applicable. Please see the response to question 2
Every effort has been made to ensure that the information provided by our
Safety & Justice Department is as accurate and comprehensive as possible.
Please be advised that we have now received ten requests from you between
October 2009 and January 2010 about crime and policing in Hagley. I have
previously advised that when persons make a number of requests for
information that are similar, about the same subject or repeated,
consideration will be given to ascertain if there is evidence of a pattern
of behaviour which could be seen to be obsessive or unreasonable and If
this is found to be the case, the Authority would consider applying the
below exemptions to future similar requests for information:
S12 of the Act `exceeds the fees limit' - by aggregating the costs to the
authority of all the requests made to date
S 14 (1) of the Act - by making future requests on the same topic
vexatious
Please be advised that we will now consider the above exemptions in
relation to any further requests that you submit regarding crime or
policing in Hagley, these exemptions will also be considered in relation
to any requests submitted by persons who are known to be acting in consort
with yourself.
Your attention is drawn to the below which details your right of
