under section 21 of the FOI Act (information accessible by other means) we
will refer you to the NHS Choices website where information on all NHS
trusts and the services they provide is available.

I should explain that it is unlikely that the Department holds a list that
meets your exact requirements.  The FOI Act does not oblige a public
authority to create information to answer a request if the requested
information is not held.  The FOI duty is to only provide the recorded
information held.

submitted within two months of the date of receipt of the response to your

Dear Department of Health,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department of Health's handling of my FOI request 'A list of all NHS Trusts that provide both mental health and community physical health services'.

I asked for a list of all mental health trusts in England that also provide community physical health services.

The response to my FOI request was to point me towards a list of ACUTE hospital Trusts on the NHS website (www.nhs.uk/ServiceDirectories/Pages/AcuteTrustListing.aspx), stating as this information was available through other means my request was refused.

This response expressly does not provide the reasonable information required. Sarah Walter, the FOI responder on behalf of the DoH, stated that "The FOI Act does not oblige a public authority to create information to answer a request if the requested information is not held. The FOI duty is to only provide the recorded
information held."

I would suggest that the Department of Health should and does know which Mental Health Trusts also provide community services, as they provide the authorisation for these services to be provided, and also reiterate that the link provided above does not provide this information.

I therefore ask that the response to my request be formally reviewed, and also that I receive the data as quickly as is reasonably possible.

To save yourself a 20-day wait for an internal review, you could have clicked the 'Mental Health Trusts' tab on the page given. I suspect the DH doesn't have a simple list of the nature you're asking for, but it's easily deducible by anyone from the web page they've provided for you.

Peter - That gives a full list of mental health trusts, yes, but it doesn't tell me which of these provide community physical health services.
