A list of all licenced and planning-approved houses of multiple occupation in Penwith

Simon Elliott made this Freedom of Information request to Penwith District Council

The request was successful.

From: Simon Elliott

4 March 2008

Dear Sir or Madam,

With many larger houses being informally set up as houses of
multiple occupation in the Penwith area, it is important for
residents to know which are licenced and also which have planning
permission for the change from private dwelling to HMO.

In having this information, residents who know of unlicenced HMO's
or those without planning permission will then be able to report
the properties.

The licence document is often referred to as the HMO Public
Register. It would need to be annotated to show those without
planning permission

Yours faithfully,

Simon Elliott
Resident of Penwith

Hi Simon

My apologies for timescale of response. The data forwarded is a public
register, and is updated on a frequent and regular basis; your request
unfortunately coincided with annual leave and a monthly update of the
spreadsheet. As the definition of an HMO under the Housing Act 2004
differs to that under planning legislation, I have forwarded this and
your original request on to Andy England, Development Control Manager to
respond independantly.

If I can be of further assistance please contact me

Dear Mr. Elliott,
I refer to the above inquiry. I apologise for the delay in responding,
however, I understand that a reply has been issued with regard to
licencing.

I can confirm that the records regarding planning permission are
available for public inspection under the Access to Information Act as
they form part of the Statutory Planning Register and as such is not
covered by the Freedom for Information Act - in that they are already a
matter of public record. You are welcome to obtain details regarding
specific properties in the normal manner, however, unfortunately we are
unable to provide a separate list relating solely to properties which
have planning permission as HIMO. If you have concerns about the
legality of specific properties we can of course investigate the matter
and advise accordingly.

Yours sincerely,

Andrew England
