ORDER 2008
Cambridgeshire County Council in exercise of its powers under Sections 1, 2, 3, 4, 19, 32,
35, 45, 46, 47, 61, 63, 64 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984
(“the Act of 1984”) and with the Traffic Management Act 2004 Part 6 and of all other
enabling powers and after consultation with the Chief Officer of Police in accordance with
Part III of Schedule 9 to the Act of 1984, hereby makes the following Order:
SECTION 1
GENERAL
COMMENCEMENT AND CITATION
1.1
This Order shall come into operation for all purposes on the 31st day of March 2008
and may be cited as The City of Cambridge (Civil Enforcement Area) (Waiting
Restrictions And Street Parking Places) Order 2008
INTERPRETATION
Definitions
1.2
In this Order, except where the context otherwise requires, the following expressions
have the meaning as hereby respectively assigned to them and where a word is
defined then other grammatical forms of that word are to be interpreted in the same
manner with the necessary grammatical change:
“the Act of 1984” means the Road Traffic Regulation Act 1984 (as amended);
“the Act of 2004” means the Traffic Management Act 2004(as amended);
“Authorised User” means those bodies, parties, organisations or individuals granted
authorised user status under the criteria approved from time to time by the Director of
Highways and Access of Cambridgeshire County Council;
“Boarding and Alighting” means:
(i)
waiting for a person to board or alight from a vehicle other than a Public
Service Vehicle provided that no such vehicle waits in the same place for
longer than two minutes; or
(ii)
waiting for no longer than necessary for passengers on board to alight from a
Public Service Vehicle and/or for passengers waiting to board a Public

Service Vehicle. The driver of a Public Service Vehicle shall not permit it to
dwell at the stop or the Bus Permit Holders Parking Place or the Public
Service Vehicles Parking Place on the expectation of other passengers
arriving to board the vehicle;
“Bus Permit Holders Parking Place” means an area of highway designated by this
Order as such;
“Bus Stop” means an area on a highway which is bounded by a marking shown in
diagram 1025 in Schedule 2 of the Traffic Signs Regulations and General Directions
2002;
“Business Proprietor” means:
(i)
the proprietor (or an employee nominated by the proprietor) of a business,
school or shop, which has no off-street Parking Places attached thereto the
address of which is in the streets or parts of streets identified in Schedules 2,
4, 5, 6, 8, 11 of this Order and Schedule 12 Part 1 of this Order;
(ii)
the head teacher of Park Street Primary School;
“Car Club” means a formally constituted car-sharing scheme approved of by the
Council to operate within its boundaries;
“Car Club Parking Place” means an area of a highway designated as such by this
Order;
“Civil Enforcement Officer” means a person authorised by or on behalf of the Council
to enforce the restrictions and regulations imposed by this Order;
“the Council” means Cambridgeshire County Council and includes its employees
several and agents;
“Disabled Person’s Badge” the same meanings as stated in Regulation 3 of The
Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England)
Regulations 2000 (Statutory Instrument 2000 No. 683)
“Disabled Person’s Parking Place” means an area of a highway designated by this
Order as such;
“Disabled Person’s Vehicle” means a vehicle displaying in the relevant position a
disabled person’s badge in accordance with Part III of The Disabled Persons
(Badges for Motor Vehicles)(England) Regulations 2000 (Statutory Instrument 2000
No. 682) (as amended)
“Doctor” means a fully registered person as defined in Section 55 of the Medical Act
1983;
“Doctor Parking Place” means an area of highway designated by this Order as such;

“Driver” means, in relation to a Vehicle Waiting in a Parking Place or road or length of
road, the person driving the Vehicle whilst it is Waiting or at the time it was left in the
Parking Place or road or length of road;
“Goods” includes postal packets of any description; and “delivering” and “collecting”
in relation to any Goods includes checking the Goods for the purpose of their delivery
or collection;
“Hackney Carriage” means a vehicle as defined in Section 38 of the Vehicles
(Excise) Act 1971 and duly licensed by the Council pursuant to its powers under
Section 37 of the Town Police Clauses Act 1847 as amended by Section 16 of the
Transport Act 1985;
“Hackney Carriage Stand” means an area on a highway designated as an area
where hackney Carriages may wait while plying for hire by this Order;
“Hours of Operation” means the hours identified in this Order in respect of each of
the following:
• Bus Permit Holders Parking Places
• Car Club Parking Places
• Disabled Person’s Parking Places
• Parking Places With Ticket Machines
• Parking Places Without Charge
• Pedal Cycle Parking Place
• Public Service Vehicle Parking Places
• Resident Parking Places
• Loading Bays and Loading Bays For Delivery Permit Holders Only and
• Hackney Carriage stands;
“Invalid Carriage” has the same meaning as defined in Section 136(5) of the Act of
1984;
“Loading Bay” means an area of highway designated as such by this Order;
“Loading Bay For Delivery Permit Holders Only” means an area of highway
designated as such by this Order;
“Medical Practitioner” means a person who provides medically associated services at
the surgeries listed in Schedule 3 to this Order;
“Medical Practitioner Parking Place” means an area of highway designated as such
by this Order;
“Motor Cycle” has the same meaning as defined in Section 136(4) of the Act of 1984
but does not include a motor cycle with a side-car attached;

“Motor Cycle Parking Place” means an area of highway designated as such by this
Order;
“Motor Vehicle” has the same meaning as stated in Sections 136(1) and 140 of the
Act of 1984;
“Order” means Cambridgeshire County Council The City Of Cambridge (Civil
Enforcement Area) (Waiting Restrictions And Street Parking Places) Order 2008 and
includes the Plans made hereunder (as from time to time amended);
“Owner” means the person to whom a Vehicle is registered at the relevant time under
the Vehicle Excise and Registration Act 1994;
“Parking Bay” means a space in a Parking Place which is provided for the Waiting of
a vehicle as indicated by the use of appropriate traffic signs;
“Parking Charge” means the charge payable for a Vehicle to Wait in a Parking Place
With Ticket Machines;
“Parking Place” means (jointly and severally) the following:
• Bus Permit Holders Parking Place
• Car Club Parking Place
• Disabled Person’s Parking Place
• Doctor Parking Place
• Motor Cycle Parking Place
• Medical Practitioner Parking Place
• Parking Place With Ticket Machines
• Parking Place Without Charge
• Pedal Cycle Parking Place
• Resident Parking Place
• Samaritan Parking Place
• Public Service Vehicle Parking Place
“Parking Place Without Charge” means an area on a highway designated as such by
this Order for which no charge is made;
“Parking Place With Ticket Machines” means an area on a highway designated as
such by this Order (being the areas identified on the Plans pursuant to this Order as
Pay and Display)
“Parking Ticket” means a ticket required to be purchased by payment of the Parking
Charge for a Vehicle to Wait in a Parking Place With Ticket Machines;
“Pedal Cycle “ means a bicycle not being a mechanically propelled vehicle and
excludes a pedal tricycle;

“Pedal Cycle Parking Place” means an area on a highway designated as such by this
Order;
“Penalty Charge” means the charge set by the Council under the provisions of the
relevant statutory requirements;
“Permit” means (jointly and severally) the following Permits issued under the
provisions of this Order:
• Bus Permit
• Business Parking Permit
• Car Club Permit
• Delivery Permit
• Doctor Parking Permit
• Medical Practitioner Parking Permit
• Resident Parking Permit
• Samaritan Parking Permit
• Visitor Parking Permit
“Permit Fee” means the fee payable pursuant to Article 9.21
“Permit Holder” means a person who has been issued with and holds a valid permit
which has been issued under the provisions of this Order;
“Plans” means the Plans attached to or made pursuant to this Order;
“Principal User” means the person who, not being the Owner, is the person who is
the main user of the vehicle whether or not with the consent of the Owner;
“Prohibited Hours” means in relation to any Prohibited Road the hours during which
Waiting and loading or unloading is prohibited as identified on the Plans pursuant to
this Order;
“Prohibited Road” means any Restricted Road or part of a Restricted Road
(excluding a Parking Place) identified on the Plans pursuant to this Order as No
Waiting No Loading;
“Public Service Vehicle” means a Vehicle adapted to carry 8 or more passengers
used in the provision of a public service not being a Hackney Carriage or a private
hire car;
“Public Service Vehicle Parking Place” means an area of highway designated as
such by this Order;

“Relevant Position” means
(i)
in the case of a Vehicle fitted with a front windscreen, the permit is exhibited
thereon either on the near side of and immediately behind the windscreen and
with its front facing forward so as to be legible from the outside of the Vehicle,
or on the dashboard or fascia panel so that the permit is legible from outside
the Vehicle:
(ii)
in the case of a Vehicle not fitted with a front windscreen, dashboard or
fascia panel, the permit is exhibited in a conspicuous position on the Vehicle
so that the permit is legible from outside the Vehicle
“Resident” means a person whose usual place of abode is at premises the address
of which is in the streets or part of streets identified in Schedule 2 of this Order;
“Resident Parking Place” means an area of a highway designated as such by this
Order;
“Restricted Hours” means in relation to any Restricted Road the hours identified on
the Plans pursuant to this Order during which specified activities are restricted;
“Restricted Road” means any road or part of a road (excluding a Parking Place)
identified on the Plans pursuant to this Order as No Waiting;
“Road” has the same meaning as in the Road Traffic Regulation Act 1984;
“Street” has the same meaning as Road;
“Samaritan Parking Place” means an area of highway designated as such by this
Order;
“The Samaritans” means the private limited by guarantee company of the same
name (company number 00757372)
“Scheduled Service” means a service operated to a schedule agreed from time to
time by the Traffic Commissioners in consultation with the operators of Public Service
Vehicles for the operation of local services as defined in Section 2 of the Transport
Act 1985;
“Surrender Event” means an event referred to in Article 9.12
“Ticket Machine” means an apparatus of a type and design approved by the
Secretary of State for the purpose of this Order whose function is to issue individually
numbered tickets which record:
• the date and time of issue of the Parking Ticket
• the payment of a Parking Charge,
• the period for which the Parking Charge has been paid, and

• the validity period of the Parking Ticket or the time at which the Vehicle must
leave the Parking Place
“Traffic Sign” means a sign or marking of any size, colour and type prescribed or
authorised under, or having effect as though prescribed or authorised under, the
Traffic Signs Regulations and General Directions 2002;
“Urban Clearway” means any road or part of a road (other than a Parking Place)
identified on the Plans where during the prohibited hours stopping is prohibited;
“Vehicle” means a Motor Vehicle or Motor Cycle;
“Wait” refers to a Vehicle stopping and remaining stationary for any period of time
whether or not with the intention of parking and whether or not the Driver is in the
Vehicle and a Vehicle shall be deemed to Wait for any period in the same Parking
Place or Parking Bay (as the case may be) if any part of it is below the Vehicle or the
Vehicle’s load (if any) whether or not the Vehicle is moved during that period;
“Waiting” has a corresponding meaning to “Wait”;
“Waiver Certificate” means a certificate issued by or on behalf of the Council for the
purposes of this Order permitting a specified Vehicle to Wait in specified
circumstances on a length or lengths of roads where the Waiting of that Vehicle
would otherwise be restricted or prohibited;
“Zone” means the streets identified in each Part of Schedule 2 to this Order;
“Zone Operative Date” means the date of introduction of Residents Parking Places
identified in Section 8 and specified in Schedule 2 of this order.
Rules of Construction
1.3
“include” “includes” and “including” are deemed to be followed by the words “without
limitation”, and general words introduced by “other” do not have a restrictive
meaning, and “for example” is not to be interpreted as if there are not other examples
nor to limit or restrict the ordinary meaning of the words preceding it.
1.4
Any reference in this Order to any enactment shall be construed as a reference to
that enactment as amended by any subsequent enactment.
1.5
The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies
for the interpretation of an Act of Parliament, and as if for the purposes of Section 17
of that Act this Order were an Act of Parliament and the Orders revoked by Article
17.1 of this Order were Acts of Parliament thereby repealed.
1.6
The restrictions, prohibitions and requirements imposed by this Order are in addition
to and not in derogation of any restriction, prohibition or requirement imposed by any
other enactment and any exception or exemption to the provisions of this Order is
without prejudice to the provisions of any other enactment.

1.7
Headings are only for convenience and do not affect the construction of this Order.
1.8
A provision of this Order which is void or unenforceable shall (to that extent) be read-
down so as to maintain validity and enforceability but it if cannot be read-down it
shall, to the extent necessary, be severed from all other provisions of this Order and
the remaining provisions shall continue to have effect.
1.9
Words importing the singular or plural number include the plural and singular number
respectively and words importing the masculine gender include the feminine or
neutral gender and references to a person or corporation include a corporation or
person respectively.
1.10 Unless stated to the contrary all limitations, restrictions and prohibitions in respect of
a Parking Place, Loading Bay and Hackney Carriage Stand only apply during their
Hours of Operation.

SECTION 2
WAITING, LOADING AND UNLOADING IN RESTRICTED ROADS & PROHIBITED
ROADS
PROHIBITION AND RESTRICTION OF WAITING OF VEHICLES
DESIGNATION
2.0
(a)
Each area of the highway identified as No Waiting on the Plans pursuant to
this Order is hereby designated a Restricted Road.
(b)
Each area of the highway identified as No Waiting no loading on the Plans
pursuant to this Order is hereby designated a Prohibited Road.
2.1
Save as provided in Articles 2.2, 2.3, 2.4, 2.5,2.6 and 2.7 of this Order, no person
shall, except upon the direction or with the permission of a police officer in uniform,
cause or permit any Vehicle other than a Pedal Cycle to Wait in any Restricted Road
during the Restricted Hours or to Wait in any Prohibited Road during the Prohibited
Hours;
EXEMPTIONS FROM WAITING RESTRICTIONS
2.2
Nothing in Article 2.1 shall prohibit a Vehicle from Waiting for so long as may be
reasonably necessary in a Restricted Road during Restricted Hours or in a Prohibited
Road during Prohibited Hours if it is reasonably necessary to do so in the following
instances (provided that paragraph (b) shall not apply in respect of Prohibited
Roads):
(a)
to enable a person to Board or Alight from the Vehicle (with out without their
personal hand luggage);
(b)
to enable the loading or unloading of Goods to premises situated on or
adjacent to and only accessible for Vehicles from the Restricted Road on
which the Vehicle is Waiting;
(c)
to enable the closing of any gate or other barrier at the entrance of premises
to or from which the Vehicle is gaining or has gained access or egress.
(d)
to enable the Vehicle to be used in connection with any
(i)
building operation, demolition or excavation in or adjacent to any
Restricted Road or Prohibited Road,
(ii)
the removal of any obstruction to traffic in any Restricted Road or
Prohibited Road,
(iii)
the maintenance, improvement or reconstruction of any Restricted
Road or Prohibited Road, or

(iv)
the laying, erection, installation, alteration, removal or repair in or
adjacent to any Restricted Road or Prohibited Road, of any sewer,
pipe, conduit, cable or apparatus for the transmission of gas, water or
electricity, telecommunications, or of any traffic sign or parking ticket
machine on any Restricted Road or Prohibited Road;
(e)
if the Vehicle is being used for fire brigade, police, ambulance or local
authority purposes;
(f)
if the Vehicle is being prevented from proceeding by circumstances beyond
the Driver’s control;
(g)
to the extent necessary to avoid an accident;
(h)
being a Vehicle in the service of a Universal Service Provider which is Waiting
whilst the Driver is:
(i)
delivering or collecting or loading or unloading postal packets to or from
addresses or public letter boxes in or adjacent to the road in which the
Vehicle is Waiting or
(ii)
servicing a telephone kiosk adjacent to the road in which the Vehicle is
Waiting;
(i)
for as long as is reasonably necessary for the Vehicle to be used in
connection with a wedding or funeral provided that the Vehicle can be
reasonably be used for that purpose only from that road;
(j)
if the Vehicle is displaying a valid Waiver Certificate issued by the Council and
the Vehicle is being used in accordance with the terms and conditions
prescribed by the said Waiver Certificate;
(k)
the Vehicle is in the service of the post office and is Waiting while postal
packages are being collected from or delivered to the Post Office at no. 33
Regent Street; or
(l)
under the direction of a Police Officer in uniform
2.3
Nothing in Article 2.1 of this Order shall prevent any person from causing or
permitting a Vehicle to Wait in any Restricted Road during Restricted Hours or in a
Prohibited Road during Prohibited Hours:
(a)
in a Parking Place in accordance with the terms of that Parking Place, or
(b)
if the vehicle is a Hackney Carriage Waiting upon any duly authorised
Hackney Carriage Stand, or

(c)
on a Bank Holiday or a Public Holiday where the Restricted Hours or
Prohibited Hours identified on the Plans pursuant to this Order are not
designated as No Waiting At Any Time
WAIVER CERTIFICATE
2.4
Nothing in Article 2.1 of this Order shall prevent any person from causing or
permitting a Vehicle to Wait in any Restricted Road during Restricted Hours or in a
Prohibited Road during Prohibited Hours if it is displaying in the Relevant Position a
valid Waiver Certificate issued by the Council and the Vehicle is Waiting in
accordance with the terms and conditions of the Waiver Certificate.
2.5
The Council may issue a Waiver Certificate on receipt of written application with at
least 24 hours working notice and may impose terms and conditions as the Council
considers appropriate.2.6 A Waiver Certificate may be cancelled at any time at the
sole discretion of the Council and shall thereupon immediately cease to be valid.
Notification of such cancellation shall be sent by post to the holder of the Waiver
Certificate at any address that the Council believes to be that person’s address and
the Waiver Certificate shall forthwith be surrendered to the Council.
WAITING BY DISABLED PERSON’S VEHICLES
2.7
(a)
Nothing in Article 2.1 of this Order shall prevent any person from causing or
permitting a Vehicle lawfully displaying in the relevant position a valid Disabled
Person’s Badge to Wait in any Restricted Road for a period not exceeding
three hours provided that the period of three hours shall be calculated by
adding all periods within any 24 hours excepting non-consecutive periods
which are separated by an interval of an hour or more.
2.7
(b)
Nothing in Article 2.1 of this Order shall prevent any person from causing or
permitting a Vehicle lawfully displaying in the relevant position a valid Disabled
Person’s Badge to Wait in any Prohibited Road for a period not exceeding
three hours provided that the period of three hours shall be calculated by
adding all periods within any 24 hours excepting non-consecutive periods
which are separated by an interval of an hour or more and provided that the
period or periods of Waiting shall fall outside of the Prohibited Hours.

SECTION 3
URBAN CLEARWAY
URBAN CLEARWAY
DESIGNATION
3.0
Each area of the highway identified as No Stopping on the Plans pursuant to this
Order is hereby designated as an Urban Clearway during the periods stated on the
Plans.
3.1
Save as provided in Articles 3.2 and 3.3 no person shall except upon the direction or
with the permission of Police Officer in uniform cause or permit any Vehicle to Wait or
stop for the periods and in the lengths of road identified as Urban Clearways on the
Plans;
3.2
Nothing in Article 3.1 shall render it unlawful to cause or permit any Vehicle to
Wait or stop for the periods and in the lengths of roads identified as Urban Clearways
on the Plans; for so long as may be reasonably necessary:
(a)
to enable a person to Board or Alight from the Vehicle;
(b)
to enable a person to load on or unload personal luggage from the Vehicle;
(c)
to enable the closing of any gate or other barrier at the entrance of premises
to or from which the Vehicle is gaining or has gained access or egress if it is
reasonably necessary for the Vehicle to Wait in the Urban Clearway to do so.
3.3
Nothing in Article 3.1 shall apply so as to prohibit any person from causing or
permitting any Vehicle to Wait in an Urban Clearway during the periods identified as
Urban Clearways on the Plans if the vehicle is being used:
(a)
in connection with any:
(i)
building operation, excavation or demolition in or adjacent to the
specified lengths of roads,
(ii)
the removal of any obstruction to traffic; or
(iii)
the maintenance improvement or reconstruction of the specified lengths
of roads ; or
(iv)
the laying erection, installation alteration or repair in, or adjacent to the
specified lengths of roads of any sewer, pipe, conduit, cable or
apparatus for the transmission of gas, water, or electricity or
telecommunications or of any Traffic Sign or Parking Ticket Machine; or
(b)
for fire brigade, ambulance, police or local authority purposes;

(c)
for the purpose of delivering or collecting postal packets as defined in Section
87 of the Post Office Act l953;
(d)
where it is required by law to stop;
(e)
where it is reasonably necessary to prevent an accident;
(f)
where the Vehicle is prevented from proceeding by circumstances outside the
Driver’s control; or
(g)
where the Vehicle has stopped within a lay-by constructed between the edge
of the carriageway of the specified road and the highway boundary; or
(h)
under the direction of a Police Officer in uniform.

HOURS OF OPERATION
4.2
The Hours of Operation of Parking Places With Ticket Machines shall be for 24 hours
on all days unless shown otherwise on the Plans pursuant to this Order
DELINEATION
4.3
The limits of each Parking Place With Ticket Machines and the limits of any Parking
Bay within such Parking Place With Ticket Machines shall be indicated by the
Council on the carriageway by appropriate Traffic Signs.
LOCATION OF TICKET MACHINES
4.4
The Council will install Ticket Machines in such positions as it thinks fit in or near
Parking Place With Ticket Machines for the satisfactory operation of those Parking
Places.
USE
4.5
Each Parking Place With Ticket Machines may only be used for the Waiting of
Vehicles in accordance with this Order.
PARKING CHARGE
4.6
Save as provided in Articles 4.16 and 4.17 no Vehicle shall Wait in a Parking Place
With Ticket Machines during the Hours of Operation except by purchase of a Parking
Ticket in advance by payment of the Parking Charge for the whole duration the
Vehicle Waits
MAXIMUM WAITING TIME
4.7
During the Hours of Operation, no Vehicle shall Wait in a Parking Place With Ticket
Machines longer than the maximum permitted time shown on the Plans regardless of
the period for which any Parking Charge may have been paid and regardless of the
otherwise apparent validity of a Parking Ticket.

DISPLAY OF PARKING TICKET
4.8
A Parking Ticket valid for the whole time the Vehicle is Waiting must be displayed in
the Prescribed Position on the Vehicle at all times whilst the Vehicle Waits in the
Parking Place With Ticket Machines
4.9
In this Section the Prescribed Position for display of a Parking Ticket on a Vehicle
Waiting in a Parking Place With Ticket Machines is one which complies with Article
4.10 and:
(a)
in the case of a Motor Cycle having a side car attached thereto
is in a conspicuous position on the near side of the Motor Cycle in front of the
driving seat; and
(b)
where the Vehicle is fitted with a front glass windscreen in the relevant
position as defined in clause 1.2;
(c)
where the Vehicle is not fitted with a front glass windscreen as specified, on
the near side of the Vehicle facing towards the near side of the road and not
less than 0.75 metres and not more than 2 metres above the surface of the
carriageway in the immediate vicinity;
4.10 Additionally, a Parking Ticket shall be so exhibited on the Vehicle that the expiration
time of the Parking Ticket is clearly visible to a person standing at the near side of
the Vehicle in the relevant position.
PROOF OF PAYMENT & NON-COMPLIANCE
4.11 Payment of the Parking Charge for a Vehicle Waiting in a Parking Place With Ticket
Machines shall only be evidenced by a Parking Ticket paid for by (or on behalf of) the
Driver covering the entire period the Vehicle has been Waiting and displayed in the
Prescribed Position
4.12 The expiry of the period for which the Parking Charge has been paid shall be
conclusively proved when either:
(i)
there is exhibited on the Vehicle (or the Driver produces) a Parking Ticket
issued by a Ticket Machine relating to the Parking Place in which the Vehicle
is Waiting and the time shown on the clock of the said Ticket Machine is later
than the period for which the Parking Charge has been paid as shown on the
Parking Ticket, or
(ii)
no Parking Ticket is exhibited (or produced).
PROHIBITION
4.13 It is prohibited for a Vehicle to Wait in a Parking Place With Ticket Machines contrary
to the terms of this Order.

NO ADDITIONAL PAYMENT AFTER INITIAL PAYMENT OF CHARGE
4.14 Once a Parking Ticket has been obtained for any Vehicle in a Parking Place With
Ticket Machines obtaining a further Parking Ticket for that Vehicle in respect of any
Parking Place With Ticket machines in that same road or street (whether or not the
same Parking Place or Parking Bay) is prohibited unless the Vehicle first leaves the
Parking Place and has complied with Article 4.15
RE-USING PARKING PLACES
4.15 A Vehicle shall not re-use any part of any Parking Place With Ticket Machines for
Waiting in the same road or street until at least 1 hour has passed since the end of its
last use irrespective of whether or not it is the same Parking Place or Parking Bay
and notwithstanding that the first Parking Ticket may not yet have expired.
EXEMPTIONS FROM CHARGES
4.16 (a)
If at the time when a Vehicle is left Waiting during the Hours of Operation in
a Parking Place With Ticket Machines, there is on all the Ticket Machines
relating to that Parking Place a notice placed by any person duly authorised by
the Council, indicating the Ticket Machine is out of order, that Vehicle shall be
exempt from the Parking Charge provided it does not Wait longer than the
maximum permitted Waiting time otherwise a Penalty Charge is payable,
(b)
when a Vehicle is left Waiting during the Hours Of Operation in a Parking
Place with Ticket Machines on a Bank Holiday or a Public Holiday that Vehicle
shall be exempt from the Parking Charge and the maximum permitted Waiting
time, and
(c)
when a Vehicle is left Waiting under the direction of a Police Officer in uniform
DISABLED EXEMPTION
4.17 A Disabled Person’s Vehicle Waiting in a Parking Place With Ticket Machines shall
be exempt from the payment of any Parking Charge and shall not be subject to the
maximum permissible Waiting time.

SECTION 5
MOTOR CYCLE PARKING PLACES
DESIGNATION
5.1
Each area of the highway identified as a Motor Cycle Parking Place on the Plans
pursuant to this Order is hereby designated as a Motor Cycle Parking Place.
DAYS AND HOURS OF OPERATION
5.2
The Hours of Operation of each Motor Cycle Parking Place shall be for 24 hours on
all days unless shown otherwise on the Plans pursuant to this Order.
USE
5.3
Each Motor Cycle Parking Place may only be used for the Waiting of a Motor Cycle
in accordance with this Order.
MANNER OF STANDING
5.4
Every Motor Cycle left Waiting in a Motor Cycle Parking Place shall stand at an angle
of 90 degrees to the nearest edge of the carriageway.
PROHIBITION
5.5
It is prohibited to use a Motor Cycle Parking Place otherwise than in accordance with
this Order.
EXEMPTION
5.6
Nothing in this Section prohibits any Vehicle from Waiting in a Motor Cycle Parking
Place
(a)
during the Hours of Operation of that Motorcycle Parking Place on a Bank
Holiday or a Public Holiday; or
(b)
under the direction of a Police Officer in uniform

Each area on a highway identified as a Doctor Parking Place on the Plans pursuant
to this Order is hereby designated as a Doctor Parking Place.
6.2
Each area on a highway identified as a Medical Practitioner Parking Place on the
Plans pursuant to this Order is hereby designated as a Medical Practitioner Parking
Place.
6.3
Each area on a highway identified as a Samaritan Parking Place on the Plans
pursuant to this Order is hereby designated as a Samaritan Parking Place.
USE
6.4
Each Doctor, Medical Practitioner and Samaritan Parking Place may only be used in
accordance with this Order for Waiting by Vehicles displaying in the Relevant
Position a valid Permit issued in respect of that Vehicle relating to that Parking Place

6.5

Each Pedal Cycle Parking Place may only be used for Waiting by a Pedal Cycle in
accordance with this Order
MANNER OF STANDING
7.3
Every Pedal Cycle left Waiting in a Pedal Cycle Parking Place shall stand only in a
rack provided in the Pedal Cycle Parking Place.
DAYS AND HOURS OF OPERATION
7.4

8.1
Each area of a highway, which is identified as a Resident Parking Place on the Plans
pursuant to this Order, is hereby designated as a Resident Parking Place.
HOURS OF OPERATION
8.2
The Hours of Operation of each Resident Parking Place shall be for 24 hours on all
days unless shown otherwise on the Plans pursuant to this Order.
USE
8.3
Each Resident Parking Place may only be used in accordance with this Order for:
(a)
the Waiting by a Vehicle displaying a valid Permit in the Relevant Position
issued in respect of that Vehicle and relating to that Parking Place, or
(b)
the Waiting by a Vehicle in a Resident Parking Place identified in Part 5 of
Schedule 2 to this Order for up to 30 minutes at a time irrespective of whether
the Vehicle has a relevant valid Permit provided it does not re-use any part of
the same Parking Place (whether or not the same Parking Bay) until at least 2
hours has passed since the end of its last use.
PROHIBITION
8.4
It is prohibited to use a Resident Parking Place otherwise than in accordance with
this Order
EXEMPTIONS
8.5
Nothing in this Section prohibits any Invalid Carriage or any Disabled Person’s
Vehicle displaying in the relevant position a valid Disabled Person’s Badge from
Waiting in any Resident Parking Place
8.6
Nothing in this Section prohibits any Vehicle from Waiting in a Resident Parking
Place during the Hours of Operation of that Resident Parking Place on a Bank
Holiday or a Public Holiday.8.7
Nothing in this Section prohibits any Vehicle from

Each Disabled Person’s Parking Place may only be used in accordance with this
Order by a Disabled Person’s Vehicle which displays in the relevant position a
Disabled Person’s Badge and is being driven or used by the person to whom the
badge is issued.

10.1 Each area of the highway identified as a Loading Bay on the Plans pursuant to this
Order is hereby designated as a Loading Bay and each area of the highway identified
as a Loading Bay For Delivery Permit Holders Only is hereby designated as a
Loading bay For Delivery Permit Holders Only.
DAYS AND HOURS OF OPERATION
10.2 The Hours of Operation of Loading Bays or Loading Bays For Delivery Permit
Holders Only shall be for 24 hours on all days unless shown otherwise on the Plans
pursuant to this Order.
MANNER OF STANDING
10.3 Every Vehicle left Waiting in a Loading Bay or a Loading Bay For Delivery Permit
Holders Only shall stand so as to be parallel to the kerb and wholly within the
Loading Bay limits delineated by markings on the carriageway or the Loading Bay
For Delivery Permit Holders Only limits delineated markings on the carriageway.
USE
10.4 (a)
A Loading Bay may only be used in accordance with this Order by Vehicles
in the course of loading or unloading of Goods to premises situated on or
adjacent to and only accessible for Vehicles from the road in which the
Loading Bay is located.
(b)
A Loading Bay For Delivery Permit Holders Only may only be used in
accordance with this Order by Vehicles in the course of loading or unloading
of Goods to premises in the the streets listed in Schedule 4 to this Order and
only accessible for Vehicles from the road in which the Loading Bay For
Delivery Permit Holders Only is located.
10.5 A Driver of a Motor Vehicle shall not use a Loading Bay or a Loading Bay For
Delivery Permit Holders Only:
(a)
so as unreasonably to
(i)
prevent access to any premises adjoining the road,
(ii)
prevent the use of the road by other persons,
(iii)
so as to be a nuisance; or
(b)
when the Council has closed the Loading Bay or the Loading Bay For Delivery
Permit Holders Only by Order so as to prevent obstruction of streets on the

Order is hereby designated as Public Service Vehicle Parking Place and each area
on a highway identified as Bus Permit Holders Only in the Plans pursuant to this
Order is hereby designated as a Bus Permit Holders Parking Place
DAYS AND HOURS OF OPERATION
11.2 The Hours of Operation of Public Service Vehicle Parking Places and Bus Permit
Holders Parking Places shall be for 24 hours on all days unless shown otherwise on
the Plans pursuant to this Order.
USE
11.3 A Public Service Vehicle Parking Place shall only be used in accordance with this
Order for Waiting by Public Service Vehicles (other than those operating on a
Scheduled Service) for the purpose of Boarding and Alighting of passengers, and
11.4 A Bus Permit Holders Parking Place shall only be used in accordance with the terms
of this Order for Waiting or for the purposes of Boarding and Alighting by Public
Service Vehicles operating on a local Scheduled Service displaying (in the Relevant
Position) and complying with the terms of a valid Bus Permit
11.5 The Driver of a Public Service Vehicle which is within the Public Service Vehicle
Parking Place or the Bus Permit Holders Parking Place:
(a)
shall not obstruct access to or egress from the Public Service Vehicle Parking
Place or the Bus Permit Holders Parking Place; and
(b)
except as provided in Article 11.6 shall not permit the Public Service Vehicle to
Wait in the Public Service Vehicle Parking Place or the Bus Permit Holders
Parking Place if the Public Service Vehicle is in a condition of disrepair or
dilapidation or is leaking oil, petrol or other fuel;
11.6 No person shall whilst a Public Service Vehicle is within the Public Service Vehicle
Parking Place or the Bus Permit Holders Parking Place carry out or permit to be
carried out to the Public Service Vehicle any work of cleaning, construction,
alteration, maintenance, or repair (except where a duly authorised representative of
the Council is satisfied upon representations being made to him or her that it would
be more expeditious for repairs to be carried out to the Public Service Vehicle in the
Public Service Vehicle Parking Place to enable it to leave rather than to require it to
be removed for such repairs).

PERMITS
ELIGIBILITY TO APPLY FOR PERMITS
Resident Parking Permit
17.1(a)
Subject to Articles 17.7 and 17.8 a person who resides in one of the streets
identified in Schedule 2 of this Order may apply to the Council for the issue of a
Resident Parking Permit for the relevant area.
Business Parking Permit
17.1(b) Subject to Article 17.7 a Business Proprietor (not being a head teacher of Park
Street Primary School) whose business is included in streets identified in Parts 2,
4, 5, 6, 8,11 and 12(1) of Schedule 2 of this Order may apply to the Council for the
issue of one Business Parking Permit for each such business and the head
teacher of Park Street Primary School may apply to the Council for the issue of
one Business Parking Permit in respect of that school.
Visitor Parking Permit
17.1(c) Subject to Article 17.8 a person who resides in one of the streets identified in
Parts 2 to 11 and Part 12(1) of Schedule 2 of this Order may apply to the Council
for the issue of up to twelve Visitor Parking Permits.
Doctor Parking Permit
17.1(d) Any Doctor may apply to the Council for the issue of a Doctor Parking Permit.
Samaritan Parking Permit
17.1(e)
Any person working for The Samaritans may apply to the Council for the issue of
a Samaritan Parking Permit.
Medical Practitioner Parking Permit
17.1(f)
The practice manager or his or her representative of any surgery specified in
Schedule 3 to this Order may apply to the Council for the issue of a Medical
Practitioner Parking Permit in respect of a Vehicle of any Medical Practitioner
associated with that surgery.

Bus Permit
17.1(g)
Any local bus operator operating Local Scheduled Services may apply to the
Council for the issue of a Bus Permit
Delivery Permit

Any occupier of a premises or the operator of a business from a premises listed in
Schedule 4 to this Order may apply to the Council for the issue of a Delivery
Permit in respect of a Vehicle Loading to or Unloading from that premises from a
Loading Bay For Delivery Permit Holders Only
Car Club Permit
17.1(i)
Any Car Club may apply to the Council for the issue of one Car Club Permit for
each Car Club Parking Bay in a Car Club Parking Place
APPLICATION PROCEDURE & EVIDENCE
17.2
All Permit applications shall be made on the relevant Permit application form
prescribed by the Council from time to time and shall include the particulars and
information required by such form to be supplied and shall be accompanied by
the Permit Fee.
17.3
The Council may at any time require an applicant for a Permit or a Permit Holder
to produce to an officer of the Council such evidence in respect of an application
for a Permit made to them as they may reasonably require to verify any
particulars or information given to them or in respect of any Permit issued by them
as they may reasonably require to verify that the applicant is entitled to apply or
that the Permit is validly issued or being validly used.
TERMS OF ISSUE
17.4
On receipt of the Permit Fee, completed application for a Permit and payment of
the Permit Fee the Council may issue a Permit for the zone in which the applicant
is eligible upon being satisfied of the applicant’s entitlement.
17.5
It is a condition of issue of a Permit that the user of the Permit complies with the
terms of the Permit and this Order.
17.6
Visitor parking Permits are only valid if the following conditions are satisfied at all
times while the Vehicle is Waiting:
(a) the Vehicle is Waiting in a Resident Parking Place,
(b) the Vehicle is Waiting whilst the Driver or passenger of the Vehicle is visiting
the person to whom the visitor parking Permit was issued,

(c) at the time the Vehicle is first left Waiting the then current correct time and
date is written legibly in ink in the relevant space on the Permit,
(d) the registration number of the Vehicle is written legibly in ink in the relevant
space on the Permit, and
(e) no alteration or correction is made to the time, date and registration number.
INELIGIBLE APPLICANTS
17.7
Any Resident or Business Proprietor of premises constructed after the date of
introduction
of the zone specified in Parts 2 to 12 of Schedule 2 of this Order and
which has off-street parking associated with the said premises complying with
Cambridge City Council’s adopted parking standards in relation to planning
applications shall not be eligible for the issue of a Permit provided for in Article
17.1(a) or (b) of this Order.
LIMIT ON PERMIT NUMBERS FOR CERTAIN STREETS
17.8
Nothing in this Section shall allow:
a) a Resident of the streets or parts of streets specified in Schedule 2 Part 12(2)
to this Order to be issued with or be in possession of more than one Resident
Parking Permit at any time; and
(b) more than ten Resident Parking Permits to be issued to Residents of the
streets or parts of streets specified in Schedule 2 Part 12(2) to this Order at
any time.
(c) a Resident of the streets or parts of streets specified in Schedule 2 Part 12(2)
to this Order to apply for, be issued with or display Visitor Parking Permits.
SURRENDER WITHDRAWAL AND VALIDITY OF PERMITS
17.9
A Permit Holder may surrender a permit to the Council at any time and shall
surrender a Permit to the Council on the occurrence of a Surrender Event.
17.10
The Council may by notice in writing served on the permit holder withdraw a
Permit if it appears to the Council that any Surrender Event has occurred and the
permit holder shall surrender the permit to the Council within forty eight hours of
the receipt of the aforementioned notice unless the Permit Holder has satisfied
the Council that the Surrender Event has not occurred.
17.11
Notice under this Article shall be served by sending it by recorded delivery or
hand delivery to the Permit Holder at the address shown on the Permit application
or at any other address believed by the Council to be that person’s place of abode
17.12
Each of the following is a Surrender Event:

(a) The Permit Holder ceasing to be a Resident, Business Proprietor, Car Club
Operator in Cambridge, Doctor, Medical Practitioner or person employed by
The Samaritans (as the case may be);
(b) The Permit Holder ceasing to be the Owner or Principal User of the Vehicle in
respect of which a Permit was issued;
(c) The issue of a duplicate Permit by the Council under the provisions of Articles
17.14, 17.15 and 17.16 of this Order;
(d) Article 17.8 is contravened,
(e) The Permit Holder otherwise failing to comply with the terms of use of the
Permit or failing to satisfy the eligibility criteria for the Permit,
(f) The Permit details being tampered with, or
(g) The Permit Fee has not been paid or was paid by cheque which has been
dishonoured.
17.13
Subject to earlier surrender or withdrawal a Permit is valid only for the period
stated on it.
APPLICATIONS FOR AND ISSUE OF DUPLICATE PERMITS
17.14
If a Permit is accidentally mutilated or defaced or the details or colouring have
become illegible or faded the Permit Holder shall either surrender it to the Council
or apply to the Council for the issue to him or her of a duplicate Permit and the
Council upon the receipt of the original Permit shall issue a duplicate Permit and
upon such issue the original Permit shall become invalid.
17.15
If a permit other than a Visitor Parking Permit is lost or destroyed the Permit
Holder may apply to the Council for the issue to him or her of a duplicate Permit
and the Council upon being satisfied as to such loss or destruction shall issue a
duplicate Permit and upon such issue the original Permit shall become invalid.
17.16
The provisions of this Order shall apply to a duplicate Permit and an application
therefor as if it were a Permit or as the case may be an application therefor.
FORM OF PERMITS
17.17
A Resident Parking Permit shall be in writing and shall include the following
particulars:
(a) The registration details of the Vehicle in respect of which the Permit has been
issued;
(b) The period during which (subject to the surrender or withdrawal) the Permit
shall remain valid;

(c) An indication that the Permit has been issued by the Council; and
(d) An indication of the zone, Parking Place or Loading Bay for which the permit is
valid.
17.18
A Visitor Parking Permit shall in all respects include the particulars specified in
Article 17.17 except that the registration details of the Vehicle displaying the
Permit and the day, month and year on which the Permit is being used shall be
inserted by the visitor in writing and in ink.
17.19
A Business Parking Permit shall in all respects include the particulars specified in
Article 17.17 except that registration details of up to three eligible Vehicles may
be inserted by the Council
17.20 (a)
A Doctor Parking Permit or a Samaritan Parking Permit or aedical Practitioner
Parking Permit shall in all respects include the particulars specified in Article
17.17 (b) to (d).
17.20 (b)
A Bus Permit shall in all respects include the particulars specified in
Article 17.17 (b) to (d)
17.20 (c)
A Delivery Permit shall in all respects include the particulars specified
in Article 17.17 (b) to (d) and an indication of the eligible premises as specified
in Schedule 4 to this Order
17.20 (d)
A Car Club Permit shall in all respects include the particulars specified in
Article 17.17 (a) to (d)
PERMIT FEE
17.21 (a)
The annual Permit Fee for a Permit for a Resident, Visitor, Business and
Medical Practitioner is as specified in Schedules 2 and 3 of this Order.
17.21 (b)
The annual Permit Fee for a Permit for a Car Club is as specified in
Schedule 5 of this Order.
SPECIAL EXEMPTIONS FOR THE ELDERLY & INFIRM
17.22
Nothing shall prevent any Resident who is elderly or infirm from applying for, and
the Council issuing thereto, any number of Visitor Parking Permits and without
charge to the Resident, providing that:
(a) the Resident’s Doctor supplies to the Council an assessment (either at the
request of the Resident or at the request of the Council upon the Resident
having given the Council written authority to seek that assessment) of the
Resident’s infirmity or lack of mobility together with an estimation of the
frequency and number of official visits to the Resident;

(b) the number of Visitor Parking Permits issued at any one time shall be such
that the maximum usage therefrom cannot exceed sixty days.
REFUND OF PERMIT FEE
17.23
A Permit Holder who surrenders a Permit to the Council before the expiration of
the Permit is entitled to a refund of part of the Permit Fee paid calculated as
below:
(a) in respect of Permits issued under provisions of Articles 17.1(a) and
17.1(b) the refund shall be calculated as one quarter of the Permit Fee for one
whole year in respect of each complete period of three months which remains
unexpired at the time when the Permit is surrendered to the Council, and
(b) in respect of Permits issued under the provisions of Article 17.1(c) shall be the
Permit fee paid for each and every minimum purchase of five days which have
not been used.
DISPLAY OF PERMITS
17.24
(a) At all times during which a Vehicle is left Waiting in a Resident, Doctor,
Medical Practitioner, Samaritan or Bus Permit Holders Parking Place or
Loading Bay For Delivery Permit Holders Only or Car Club Permit Holders
Parking Place there shall be displayed in the Relevant Position on the Vehicle
a valid Permit issued in respect of that Vehicle and that zone or Parking Place
or Loading Bay so that all the particulars referred to in Articles 17.17, 17.18,
17.19 and 17.20 of this Order are legible and readily visible from the outside of
the Vehicle
(b) Further the user of a Visitor Parking Permit:
(i)
at the time of first leaving the Vehicle shall write legibly in ink on the
Permit in the space provided the correct date and time it is first left, and
(ii)
shall write the registration details of the Vehicle on the space provided,
and
(iii)
shall not alter the details first written under (i) and (ii)

PROHIBITION
17.25
It is prohibited for a Vehicle to Wait in a Resident, Doctor, Medical Practitioner,
Samaritan or Bus Permit Holders Parking Place or Loading Bay for Delivery
Permit Holders Only or Car Club Permit Holders Parking Place unless a valid
Permit is displayed in accordance with Article 17.24.

SECTION 18
MANNER OF STANDING, REMOVAL OF VEHICLES, SUSPENSION OF PARKING
PLACES, WAIVER CERTIFICATES & EXEMPTIONS
MANNER OF STANDING
18.1 Every Vehicle left Waiting in a Parking Place or Loading Bay or Hackney Carriage
Stand in accordance with the provisions of this Order shall stand:
(a)
so that every part of the Vehicle is within the limits of the Parking Place or
Loading Bay or Hackney Carriage Stand (and in the case of a Parking Place,
within a particular Parking Bay, if any),
(b)
so that in Parking Places, Loading Bays or Hackney Carriage Stands parallel
to the kerb, the distance between the edge of the carriageway and the
nearest wheel of the Vehicle is not more than twelve inches; and
(c)
so that the Vehicle does not obstruct the access to any off-street parking or
loading/unloading facilities.
ALTERATION OF POSITION OF VEHICLE
18.2 Where any Vehicle is left Waiting in a Parking Place, or Waiting in a Loading Bay or
Hackney Carriage Stand in contravention of the provisions of the last preceding
Article a Parking Attendant or a police constable in uniform may alter or cause to be
altered the position of the Vehicle in order that its position shall comply with those
provisions.
REMOVAL OF VEHICLES
18.3 Where a Civil Enforcement Officer is of the opinion that any of the provisions
contained in this Order have not complied with in respect of a Vehicle left Waiting in a
Parking Place, Loading Bay or Hackney Carriage Stand he or she may remove or
cause to be removed the Vehicle from the Parking Place, Loading Bay or Hackney
Carriage Stand and where it is so removed shall provide for the safe custody of the
Vehicle.
MOVEMENT OF VEHICLES IN EMERGENCIES
18.4 A police constable in uniform or a Civil Enforcement Officermay move or cause to be
moved in case of emergency to any place he or she thinks fit any Vehicle left Waiting
in a Parking Place, Loading Bay or Hackney Carriage Stand.

SUSPENSION OF PARKING PLACES, LOADING BAY OR HACKNEY CARRIAGE
STAND
18.5 Any person duly authorised by the Council may suspend the use of a Parking Place,
Loading Bay or Hackney Carriage Stand or any part thereof whenever he or she
considers such suspension reasonably necessary:
(a)
for the purpose of facilitating the movement of traffic or promoting traffic or
pedestrian safety;
(b)
for the purpose of
(i)
any building operation, demolition or excavation; or
(ii)
the maintenance improvement or reconstruction of the highway, or
(iii)
the laying erection installation alteration removal or repair of any sign or
any pipe conduit, cable or apparatus for the transmission of gas, water,
sewer, electricity or telecommunications in or adjacent to the Parking
Place, Loading Bay or Hackney Carriage Stand;
(c)
for the convenience of occupiers of premises adjacent to the Parking Place,
Loading Bay or Hackney Carriage Stand on any occasion of the removal of
furniture from one office or dwelling-house to another or the removal of
furniture from such premises to a depository or to such premises from a
depository;
(d)
on any occasion when it is considered reasonably likely that pedestrian or
vehicular obstruction will otherwise occur; or
(e)
for the convenience of occupiers of premises adjacent to the Parking Place,
Loading Bay or Hackney Carriage Stand at times of weddings or funerals or
on other special occasions.
18.6 Any person suspending the use of a Parking Place, Loading Bay or Hackney
Carriage Stand or any part thereof in accordance with the provisions of preceding
Articles shall cause to be placed in or adjacent to that Parking Place, Loading Bay or
Hackney Carriage Stand (or the part thereof the use of which is suspended) a Traffic
Sign indicating that Waiting by Vehicles is prohibited.
PROHIBITION AGAINST USING A SUSPENDED PARKING PLACE, LOADING
BAY OR HACKNEY STAND
18.7 It is prohibited for a Vehicle to Wait in any or part of a Parking Place, Loading Bay or
Hackney Carriage Stand during such period as there is in or adjacent to that part of
the Parking Place, Loading Bay or Hackney Carriage Stand a Traffic Sign placed in
pursuance of the preceding Article.

PROHIBITION AGAINST SELLING FROM VEHICLES
18.8 No person shall use any Vehicle while it is in a Parking Place, Loading Bay or
Hackney Carriage Stand in connection with the sale of Goods or services to any
person in or near that Parking Place, Loading Bay or Hackney Carriage Stand,
provided that this prohibition shall not apply to the plying for hire by a Hackney
Carriage.
EXEMPTIONS FROM WAITING RESTRICTIONS
18.9 Nothing in this Order prohibits a Vehicle from Waiting in a Parking Place, Loading
Bay or Hackney Carriage Stand:
(a)
for so long as may be reasonably necessary to enable a person to Board or
Alight from the Vehicle;
(b)
because the Vehicle is being prevented from proceeding by circumstances
beyond the Driver’s control;
(c)
to the extent necessary to avoid an accident;
(d)
if the Vehicle is being used for fire brigade, police , ambulance or local
authority purposes;
(e)
in connection with the removal of any obstruction to traffic; or
(f)
being a Vehicle in the service of a Universal Service Provider which is Waiting
whilst the Driver is:
(i)
delivering or collecting or loading or unloading postal packets to or from
addresses or public letter boxes adjacent to the Parking Place, Loading
Bay or Hackney Carriage Stand in which the Vehicle is Waiting or
(ii)
servicing a telephone kiosk adjacent to the Parking Place, Loading Bay
or Hackney Carriage Stand in which the Vehicle is Waiting.
WAIVER CERTIFICATE
18.10 Nothing in this Order prohibits a Vehicle from Waiting in any Parking Place, Loading
Bay or Hackney Carriage Stand if it is displaying in the Relevant Position a valid
Waiver Certificate issued by the Council and the Vehicle is Waiting in accordance
with the terms of the Waiver Certificate.
18.11 The Council may issue a Waiver Certificate on receipt of written application with at
least 24 hours working notice and may impose terms and conditions as it considers
appropriate.
18.12 A Waiver Certificate may be cancelled at any time at the sole discretion of the
Council and shall thereupon immediately cease to be valid. Notification of such

cancellation shall be sent by post to the holder of the Certificate at any address that
the Council believes to be that person’s address and the Certificate-holder shall
forthwith surrender the Certificate to the Council.
WAITING BY DISABLED PERSON’S VEHICLES
18.13 Nothing in this Order requires the Driver of a Vehicle lawfully displaying in the
relevant position a valid Disabled Person’s Badge which is Waiting in any Resident
Parking Place or Parking Place With Ticket Machines to pay any Parking Charge or
to observe any maximum permitted Waiting time limit.

SECTION 19
CONTRAVENTIONS AND PENALTY CHARGE
CONTRAVENTION
19.1 Where a contravention of this order constitutes a parking contravention within the
meaning of The Act of 2004, or successor legislation, the contravention shall be
subject to the penalties and procedures provided for by that legislation.
19.2 Where a contravention of this order constitutes a parking contravention within the
meaning of The Act of 2004 a Penalty Charge is payable for each calendar day or
part thereof that the Vehicle is in contravention of this Order by the Owner and the
Vehicle may be removed by or on behalf of the Council in accordance with the the
provisions of the Act of 2004 and of this Order.
19.3 A contravention of this order which does not constitute a parking contravention within
the meaning of The Act of 2004, or successor legislation, is an offence under section
35A(1) of the 1984 Act.
REMOVAL OF VEHICLES
19.4 Where a Civil Enforcement Officer has removed or caused to be removed a Vehicle
in accordance with Article 19.2
(a)
he/she shall provide for the safe custody of the Vehicle;
(b)
the Council shall be entitled to recover from the Owner or the person
responsible such charges as provided by the Act of 2004 in respect of the
removal, storage and disposal of the Vehicle
(c)
the provisions of the 1984 Act as amended shall apply to the disposal of such
Vehicles removed by or on behalf of the Council pursuant to this Article.
