REVIEW OF A REQUEST UNDER THE FREEDOM OF INFORMATION (SCOTLAND) ACT 2002 (THE “ACT”)
I refer to your email of 22 April 2009 relative to your email of 20 March 2009. I understand you made your request under the Act.
I understand you had not received any response to your information request. Accordingly I have now conducted a review of this matter, addressing the issue of the delay in dealing with your request.
Firstly, on behalf of the Council I apologise for the protracted delay in responding to your request and secondly thank you for your forbearance with regard to this delay. You should have received a response to your request within the twenty working day time frame set down in the legislation and I apologise that you did not.
I have carried out an investigation to ascertain the reasons for the delay in responding to you. In conducting the investigation I have concluded that the reasons for the delay in responding to your request centres on officer resources together with a large increase in the volume of requests. The officer who is responsible for the information you requested has also experienced an increase in workload.
I understand that a response to your request for information has now been sent to you by Robert Gibson, Senior Officer, Rights and Enquiries Section, Social Work Services, dated 8 May 2009.
I trust this will answer your request fully, however, if you are not satisfied with the response you receive you can request a review of said response.
If you are not satisfied with the response you have received in this letter you have the right to make an application within six months of receipt of this letter for a decision by the Scottish Information Commissioner, Kinburn Castle, Doubledykes Road, St Andrews KY16 9DS.
