23 December 2009
Dear Mrs Speers
OUTCOME OF A REQUEST UNDER FREEDOM OF INFORMATION (FOI) ACT
2000 FOR INTERNAL REVIEW (REF: 401847R) 1. Thank you for your email of 17 December, which said:
“Please pass this on to the person who conducts Freedom of
Information reviews.
I am writing to request an internal review of Department of
Health's handling of my FOI request 'Management statistics of NHS
and Foundation Trusts'.
You wrote to me:
"Please may I ask you to accept our apologies for the delay in
responding to you. Unfortunately, we had wrongly related this
internal review request with that for your other request for an internal
review concerning NHS statistics and data validation. You will recall
receiving my letter of 25 June. We will now fast-track this outstanding
request and will aim to provide you with a reply by Friday 17 July at
the very latest.
I am still waiting!
A full history of my FOI request and all correspondence is
available on the Internet at this address:
http://www.WhatDoTheyKnow.com/request/management_statistics_
of_nhs_and”
2. I have checked our records, and the internal review of your FOI request
on
'Management statistics of NHS and Foundation Trusts (our
reference: 401847R) was completed and sent to you on 25 June. It is
1
available from the WhatDoTheyKnow website:

hs_and
3. On 14 July, a colleague then sent a response about your internal review
request on health service guidance (our reference: 401851R):
I am writing to you about your recent email seeking a response to
your original request on 27 March seeking an internal review into
your previous correspondence concerning the HSG (94) 27.
Please may I ask you to accept our apologies for the delay in
responding to you. Unfortunately, we had wrongly related this
internal review request with that for your other request for an internal
review concerning NHS statistics and data validation. You will recall
receiving my letter of 25 June. We will now fast-track this outstanding
request and will aim to provide you with a reply by Friday 17 July at
the very latest.
With the above in mind, it would be very much appreciated if you
were able to provide case reference numbers we usually quote with
any further requests for information under the provisions of the
Freedom of Information Act (FOIA) to avoid any confusion in the
future.
4. This response relates to the internal review on health service guidance
(401851R), and should have been emailed to
request-13092-
[email address]. However, as it was emailed to
[FOI #9551 email], it appeared on the
page of your request for Management statistics of NHS and Foundation
Trusts (401847R). This gave the incorrect impression that your internal
review on NHS statistics and data validation had not been resolved.
5. As a further note, the other internal review on health service guidance was
completed on 20 August 2009, and a copy is available via WhatDoTheyKnow:
http://www.WhatDoTheyKnow.com/request/health_service_guidance_hsg#inc
oming-40697
As we have established that an internal review had already been conducted and
was sent to you on 25 June, this review is now complete.
If you are not content with the outcome of your complaint, you may apply directly
to the Information Commissioner’s Office (ICO) for a decision. Generally, the ICO
cannot make a decision unless you have exhausted the complaints procedure
provided by the Department. The ICO can be contacted at:
