FREEDOM OF INFORMATION APPLICATION
Thank you for your request for information received by Lancashire Constabulary on the 13th March, 2009, relating to your previous subject access request made in the summer of 2007.
Your request for information has now been considered and I am not obliged to supply the information you have requested under the Freedom of Information Act 2000. Such information is exempt by virtue of Section 40(2) of the Act. This exemption applies because the right given under the Act to request official information held by public authorities does not apply to personal data - any such requests become subject access requests under the Data Protection Act 1998.
In accordance with the Act, this letter represents a Refusal Notice for this particular request. As per Section 40(5) of the Act, this letter should not be taken as a confirmation or denial that Lancashire Constabulary holds any information about a `Mr Brian Higham'.
However, should you wish to know what information (if any) Lancashire Constabulary holds about you, a Subject Access form must be completed. Payment of a £10 fee and proof of identification must accompany a completed application form. Such a form can be provided on request (by telephoning 01772 413329) or via the Constabulary website (www.lancashire.police.uk). When completing the form, please be specific about what information is required in Section C of the form (i.e. the contents of your email dated the 25th February 2009 will suffice).
Please note that once we have received your completed application the process to provide you with information can take up to 40 days.
If you are unhappy with the service you have received in relation to your request and wish to make a complaint or request an internal review of our decision, you should write to the Data Protection and Information Officer, Corporate Support and Information Services - Data Protection, Police Headquarters, Saunders Lane, Hutton, Preston PR4 5SB or alternatively send an email to [Lancashire Constabulary request email]. If you are not content with the outcome of your complaint, you may apply directly to the Information Commissioner for a decision. Generally, the Information Commissioner's Office cannot make a decision unless you have exhausted the complaints procedure provided by Lancashire Constabulary.
