Freedom of Information Act Complaint

Thank you for your email dated 20 March 2009 asking for an internal review to be considered of the handling of your FOI request `Annex to EC Regulation No 622/2003'.

I am writing to confirm that the Department will now undertake an internal review of our decision letter dated 19 March 2009.

We aim to respond to your complaint within 20 working days and, therefore, we expect to be able to provide a reply by Wednesday 22 April 2009.

You have rightly pointed out that we did not provide details of how to ask for an internal review nor how to complain to the Information Commissioner. This was an administrative oversight in my original reply, for which I apologise. I have provided these details in the attachment.

In order to properly respond to your request, I would be most grateful if you could provide clarification on what you are seeking. In your first e-mail dated 10 March 2009, you requested “the list of prohibited goods from cabin baggage that are detailed in the Annex to Commission Regulation (EC) No 622/2003”. But your second e-mail asks for “the annex text of EC Regulation No 622/2003”. As indicated in my first reply, the list of prohibited goods from cabin baggage detailed in the current EC Regulation 820/2008 is the same list as was detailed in EC regulation 622/2003 (as amended). I have referred you to where it is available.

If you are unhappy with the way the Department has handled your request or with the decisions made in relation to your request, you may complain within two calendar months of the date of this letter by writing to me at the above address. Please see attached details of DfT's complaints procedure and your right to complain to the Information Commissioner.from [department] you may ask for an internal review. Your right to complain to DfT and the Information Commissioner

You have the right to complain about the way in which your request for information was handled and/or about the decision not to disclose all or part of the information requested. In addition, a complaint can be made that DfT has not complied with its FOI publication scheme.

Your complaint will be acknowledged and you will be advised of a target date by which to expect a response. Initially your complaint will be re-considered by the official who dealt with your request for information. If, after careful consideration, that official decides that his/her decision was correct, your complaint will automatically be referred to a senior independent official who will conduct a further review. You will be advised of the outcome of your complaint and if a decision is taken to disclose information originally withheld, this will be done as soon as possible.

If you are not content with the outcome of the internal review, you have the right to apply directly to the Information Commissioner for a decision. The Information Commissioner can be contacted at:
