Thank you for your email of 10 March 2009, in which you asked for the following 
details relating to Her Majesty’s Courts Service from the Ministry of Justice (MoJ):  
 
     On a yearly basis from 2000 onwards, unless of course money was 
     paid to Common Purpose from an earlier period, in which case please 
     include information from the earlier period: 
 
1.  Name all employees/staff/Judges who have attended a Common Purpose 
course? 
 
2.  How much money has been paid to this organisation? 
 
3.  Please provide copies of invoices/receipts 
 
Your query was passed to my team on 16 March 2009 because I have responsibility 
for answering requests under the Freedom of Information Act 2000 (FOIA) which 
relate to expenditure across the Ministry of Justice as a whole.   
 
For the first and last element of your enquiry, I can confirm that the Department holds 
the information you are seeking, but I am unable to disclose it in full to you.  This is 
because the information is the personal data of another person, and disclosure would 
be unfair to that other person who is the subject of the data. We are unable to supply 
copies of the invoices for the same reason, as the names of those attending the 
courses are shown.  
 
Section 40(2) of the FOIA states that personal data relating to third parties (i.e. a 
party other than the person requesting the information) is exempt information if one 
of the conditions in Section 40(3) is satisfied.  It is my view that disclosure of this 
information would breach one or more of the Data Protection Principles in the Data 
Protection Act 1998 (DPA).

For the second part of your query, I am, however, able to provide you with the details 
of payments made to Common Purpose by MoJ Accounts Payable on behalf of Her

Section 12 of the FOIA makes provision for public authorities to refuse requests for 
information where the cost of dealing with them would exceed the appropriate limit, 
which for central government is set at £600.  This represents the estimated cost of 
one person spending 3.5 working days in determining whether the Department holds 
the information, locating, retrieving and extracting the information. The invoices held 
for information prior to 2005 are archived off site and it is anticipated it would exceed 
the cost limit to retrieve and review copies of this information, bearing in mind the 
time already spent in collating the information above. 
 
You may wish to narrow the scope of your request in order to try and bring it within 
the cost limit, for example, you may wish to request details of a smaller number of 
invoices only or for a shorter financial period.  
 
As part of our obligations under the FOIA, the Ministry of Justice has an independent 
review process.  If you are dissatisfied with this decision, you may write to request an 
internal review.  The internal review will be carried out by someone who did not make 
the original decision, and they will re-assess how the Department handled the 
original request.
