29 April 2009

Dear Dr Hamer

Freedom of Information Request Reference No: 165-09-134

I refer to my previous letter dated 15 April 2009 and your response that the incident
you refer to may have been on an earlier day in the week i.e. sometime between 15
and 20 February 2009.

Surrey Police records have been researched and located an incident which police
attended in Sandcross Lane during the early hours of 18 February 2009.

I am not obliged to supply any further details or information you have requested

FOI Section 40(2) Personal Information and Section 30(1) Investigation exemptions
apply to your request and disclosure of information would also be a breach of the Data
Protection Act 1998

Section 17 of the Freedom of Information Act 2000 requires Surrey Police, when
refusing to provide such information (because the information is exempt) to provide
the applicant with a notice which: (a) states that fact, (b) specifies the exemption in
question and (c) states (if that would not otherwise be apparent) why the exemption
applies. Accordingly this letter serves as such a notice.

Surrey Police provides you the right to request a re-examination of your case under its
review procedure. How to do this is set out in the attached Appeals Notice.  Having
followed the full procedure, if you are still dissatisfied, then you have the right to direct
your comments to the Information Commissioner who will give your case
consideration.

Yours sincerely
