Dear C. Evison,

Thank you for your email of 19 May 2009, where you have requested information about the total amount of illegal working civil penalties collected from employers served with a Notice of Liability (NOL) in lieu of illegal migrant workers during the period between 29 February and 31 December 2008. This falls to be dealt with under the Freedom of Information Act 2000. I am sorry for the delay in responding to your request.

Our records show that you have already written in on 20 March 2009 requesting substantially similar information and you were sent a reply to this request on 8 May 2009.

I do not believe that a reasonable interval has passed since you made your first request and we are therefore not obliged to comply with your request under section 14 (2) of the Freedom of Information Act 2000. This is because the period of time over which the objections and appeals processes are dealt with by the Civil Penalty Compliance Team (CPCT) and HM Courts, respectively, is frequently protracted over several months and as such the information contained within the reply to your previous request has not changed substantially.

If you are dissatisfied with this response, you may request an independent internal review of our handling of your request. Internal review requests should be submitted within two months of the UK Border Agency sending a substantive reply to your original request and should be addressed to:

During the independent review, the department's handling of your information request will be reassessed by staff who were not involved in providing you with this response.
