Dear Mr. Peach
Re: Your request for information
I write in response to your email dated 30th August 2011.
Please accept my sincere apologies for the delay in responding to your request.
I have investigated your request and the answers to your questions are as follows.
1. Any internal correspondence it has setting out why the Council has not been
meeting its statutory obligations?
In accordance with section 1 of this act this information cannot be provided as it is not
held by this authority.
We have however as an organisation considered what actions should be taken as a
result of non-compliance and these actions are detailed in our Action Plan.
Further, we have received a similar request for ‘information and communications
relating to FOI procedures’ and I can confirm that that information was exempted from
release under Section 36 of the Act and it is likely that if we had held any information
specifically relating to this question, we would have sought to apply the section 36
exemption to that material.
2. Whether the poor performance has been brought to the attention of the Chief
Executive?
Yes
3. What actions Nottingham City Council have taken, and also plan to take, to
address this poor performance.
Please see the attached action plan entitled,
“11-9340 Action Plan (Update as at 100811).pdf”
4. Any definite targets set for when performance will improve and what is
considered an acceptable level of performance.
Please see our response to question 3 above.
If you should have any questions please contact me on the above number quoting
your personal case reference which is
IGO/11-9340.
If you are not satisfied with the response provided or any exemptions applied you
should write in the first instance to
Stephanie Pearson, Information Governance,
1st Floor, Loxley House, Station Street, Nottingham, NG2 3NG stating the reasons
for your dissatisfaction.
If you remain dissatisfied after receiving the response to your initial complaint you can
request an independent review from the Information Commissioner's Office at
FOI/EIR Complaints Resolution, Information Commissioner's Office, Wycliffe
House, Water Lane, Wilmslow, Cheshire SK9 5AF. You may also contact the
Information Commissioner's Office by telephone on 01625 545745 or by email at
