Two requests for a copy of the Council’s response to the 
DCSF’s questionnaire responding to Elective Home 
Education Provision 
 
Consideration: 
Withhold under Section 36(2)(b) of the Freedom of 
Information Act in that disclosure of the information 
would, or would be likely to, inhibit the free and frank 
provision of advice or the free and frank exchange of view 
for the purposes of deliberation and under Section 
36(2)(c) of the Act in that disclosure would otherwise 
prejudice, or would be likely otherwise to prejudice, the 
effective conduct of public affairs. 
 
Result: 
The unanimous decision of the Public Interest Test Panel 
was to release the information.
