REQUEST FOR REVIEW UNDER THE FREEDOM OF INFORMATION (SCOTLAND) ACT 2002 - (the “ACT”)

I refer to your email of 17 March 2009 relative to your email of 16 February 2009. I understand you made a request under the Act.

I understand you have not received any response to your information request. Accordingly, I have now conducted a review of this matter, addressing the issue of the delay in dealing with your request.

On behalf of the Council I apologise for the delay in responding to your request. You should have received a response to your request within the twenty working day timeframe set down in the legislation and I apologise that you did not.

I have carried out an investigation to ascertain the reasons for the delay in responding to you. I am informed that officers dealing with the content of the information you requested were absent from the office on Council business and as such it was not dealt with in accordance with Council procedures.

I further understand that a response to your request has been sent to you by Robert Gibson, Senior Officer, Rights and Enquiries Section, Social Work Services. I trust this will answer your request fully, however if you are not satisfied with Mr Gibson's response you can request a review of the decision contained in Mr Gibson's letter.

If you are not satisfied with the response you have received in this letter you have the right to make an application within six months of receipt of this letter for a decision by the Scottish Information Commissioner, Kinburn Castle, Doubledykes Road, St Andrews KY16 9DS.
