Freedom of Information Act Request

I am writing in response to your request for the following further information from the Ministry of Justice (MOJ).

  1. What is your department's policy regarding allowing non-governmental bodies to use prison property and is it normal policy not to keep records?

  1. What is the name of the governor who authorised this use of Norwich Prison by Common Purpose?

  1. What job are they doing now?

  1. What efforts have you made to contact them and get answers to the questions made in the original FOI request?

  1. If efforts have not been made to contact them, why?

  1. Who else in Norwich Prison knew about the use of these facilities by Common Purpose? Have you asked them the questions as set out in the original FOI request? If not, why not?

Your request has been handled under the Freedom of Information Act 2000 (FOIA).

There is no policy regarding allowing non-governmental bodies to use prison property. This is at the discretion of the Governor providing that all security policies are adhered to. This accommodation is now being used by prison administration departments.

Questions 2 & 3

I can confirm that the Department holds the information you are seeking, however we have considered the public interest in disclosure but on balance we have decided that the rights and interest of the individual concerned must be protected. Therefore this information is exempt by virtue of Section 40(2) of the FOIA which states that personal data relating to third parties (i.e. a party other than the person requesting the information) is exempt information if one of the conditions in Section 40(3) is satisfied. It is my view that disclosure of this information would breach one or more of the Data Protection Principles in the Data Protection Act 1998 (DPA).

Questions 4-6

Any agreement for use of office accommodation at HMP & YOI Norwich was made on a verbal basis. Therefore, we do not hold any recorded information that relates to your questions numbered 4-6.

As part of our obligations under the FOIA, the Ministry of Justice has an independent review process. If you are dissatisfied with this decision, you may write to request an internal review. The internal review will be carried out by someone who did not make the original decision, and they will re-assess how the Department handled the original request.
