Dear Leeds City Council,

I want to make a Freedom of Information request in relation to 79
Park Avenue, Allerton Bywater, Yorkshire WF10, this has recently
been converted from a detached shop, into a residential property.

I am making this request on behalf of concerned local residents as
there are numinous rumours regarding what the use is going to be,
these include a hostel or an asylum house.

Therefore please can you send copies of the following?
1: All planning applications
2: Copies of all minutes regarding the above property
3: Copies of all decision notices regarding the above property
4: Any contracts/agreements with 3rd party companies regarding
running the property.
5: The cost of the all works to the property.

Dear Sir/Madam,

I write in response to your Freedom of Information request, received in
this office on 25th February 2011.

With regard to your request, Leeds City Council has not received a
planning application for 79 Park Avenue, Allerton Bywater, however, upon
examining your request, the description of the property you refer to would
not seem to fit with this address. I have, as such, carried out further
investigation, and note that the property 89 Park Avenue would fit with
the description you have given.

A planning application, for this property was received, requesting a
'change of use of existing shop unit to 5 bed dwelling', however, this
application has not been determined as of the current date. As your
request suggests that the property has already been converted, I have,
therefore, as an officer of the Council, referred this alleged change of
use to our Planning Compliance service, and asked them to investigate as
to whether or not enforcement action is required.

If you would like to be kept updated of the findings of the Compliance
investigation, please let me know, and I will pass your details on to the
service (It would be appreciated if you could provide a private contact
address/number for this, as opposed to using the whatdotheyknow.com
website).

Additionally, for reference, please note that as planning applications are
publicly available, requests asking for information from them are exempt
from release under the Freedom of Information Act by virtue of S21
(Information Accessible By Other Means). Information on planning
applications can be obtained from our Development Enquiry Centre, and the
Leeds City Council Planning Public Access website. I have provided contact
details below for reference.

held by Planning Services.

independent officer within City Development. On appeal, your request will
be re-examined and an assessment made as to whether the requirements of
