REQUEST FOR INFORMATION   
We refer to your request for information under the Freedom of Information Act 
2000 (FOIA) received by the Olympic Delivery Authority (ODA) on 2 February 
2009 requesting the following information: 
Under the Freedom of Information Act 2000, please supply the PM10 
data from each of these monitoring points for the month of January 2009 
and present them in: 
a)  Tabular format; to facilitate ease of comprehension of the data. 
b)  Graphical format, to facilitate identification of anomalies. 
We confirm that we hold information of the description specified in your 
request.  
Due to the nature of the information which you have requested, we have 
interpreted your request in terms of the Environmental Information Regulations 
2004 -(EIR). Under regulation 12(4)(d) of the EIR, we may refuse to disclose 
information to a requestor where the request relates to material which is still in

the course of completion, unfinished or incomplete. The ODA compiles 
monthly reports in relation to the PM10 and dust information collected on the 
Olympic Park (OP) and is currently in the process of compiling the report for 
the January 2009 information which you have requested. Accordingly, the 
ODA considers that the regulation 12(4)(d) exception is engaged in relation to 
the January 2009 PM10 data, as we are still in the process of analysing this 
data and preparing a report which is in an unfinished and incomplete state. 
The exception is qualified and the public interest test must be applied to 
determine whether the public interest in maintaining the exemption outweighs 
the public interest in disclosing the information.  
We consider that it would be reasonable and appropriate not to disclose this 
information before it has been finalised and ratified. We believe that, in all the 
circumstances of the case, the public interest in maintaining the exception 
outweighs the public interest in disclosure of the information at this point in 
time because the data is still required to go through a ratification process to 
ensure it meets the stringent quality assurance requirements. However, we 
can advise you that the January 2009 report should be completed in late 
March. The ODA considers that the reasonably short delay before the 
completion of the January 2009 report will cause minimal harm to the public 
interest and will, in fact, facilitate and ensure accurate interpretation of the 
data by the public. We will be sure to forward a copy of the finalised report to 
you in late March once it has been completed.  
However, in the mean while, we have provided you with a copy of the most 
recent finalised report for November 2008 (Annex A) which will give you an 
indication of the information which you will receive once the January 2009 
report has been completed. For your information, we can inform you that the 
December 2008 report should be finalised in early March 2009. 
We trust that the information provided will be of assistance to you. However, if 
you are not satisfied with the response to your request and wish to make a 
complaint, you should write to The Information Officer, Olympic Delivery 
Authority, One Churchill Place, Canary Wharf, London, E14 5LN. Please state 
detailed grounds for your complaint.   
If you are not satisfied with the outcome of your complaint, you may apply 
directly to the Information Commissioner for a decision. Generally, the 
Information Commissioner will not make a decision unless you have 
 

 
exhausted the complaint procedure provided by the ODA. The Information
