Dear Mr Anderson

FREEDOM OF INFORMATION REQUEST REFERENCE NO: 165-09-082

I write in connection with your request for information received on 4th  February
I have repeated your questions below for ease of reference.

As of the 4th of December 2008

Q1.  How many DNA and fingerprint samples of innocent people have deleted?
A1. There have been 10 deletions during 2008

Q2. How many innocent people requested their DNA and fingerprint samples to be
deleted?
A2. During 2008 there were 25 requests for removals of which 10 were agreed.  The
remainders are either ongoing, were rejected, or were asked for further information
which as yet has not been forthcoming.

Q3. If no DNA and fingerprint samples have been deleted i wish to know the reasons
WHY as the UK Government have been found to be in breach of innocent peoples
human rights and this would be considered a crime in itself.
A3. N/A - we have agreed to deletions as above in A1&2. Also see A4 below

Q4.  As there is no right of appeal from a final decision made by the Grand Chamber
when will your police force be routinely be deleting records of innocent people?
A4.   All chief officers have been sent two documents regarding deleting records.  I
have attached copies for your information

Contact details and operational details have been redacted from the enclosed
documents to prevent the relevant operational teams from being inundated with
contact from individuals which would cause disruption to the operation, therefore
prejudicing effective law enforcement. This is not in the public interest. Section
31(1)(a)(b)(c)  Law Enforcement exemption is therefore engaged.
