I am writing to confirm that the Department has completed its search for the information which you requested on 10th June - FoI request number F0004242 - relating to FoI performance within the Department for Transport.

Under section 21 of the Act, we are not required to provide information which is already reasonably accessible to you. The information you requested in points a) and b) of your

e-mail is available on the Ministry of Justice's website, in a quarterly report format. The following web-address will take you to the right area of the website and you can then choose which quarters to view. The most recent reports are on that page but the link on the right hand side of that page will also show you archived reports going further back. (Unfortunately there is a restriction on copying this link so I have been unable to provide it as a direct hyperlink).

The figures you are interested in are on the “Timeliness” page of each spreadsheet. If you do not have access to the Internet at home, you may be able to use facilities at your local public library, or you can request a paper copy by contacting me.

In respect of point c) of your request I can advise you that following a search of our paper and electronic records, I have established that the information you requested is not held by this Department.

With regard to points d) and e) of your request I can advise you of the following.

There is a internal departmental target of 93% but our objective is to achieve 100%, as set out in the requirements of the Act . We do, however, continue to look at ways to improve on performance and implement good practice across the Department. To help achieve this we have a dedicated Information Rights Team who provide an advice service to staff, in particular with more complex FOI cases. In addition, the team monitors and reports on performance, provides specialist training and produces guidance on our internal website which is frequently updated, along with facilitating a local practitioners' network to enable casehandlers to share and pass on their skills and experiences and discuss emerging trends.

If you are unhappy with the way the Department has handled your request or with the decisions made in relation to your request you may complain within two calendar months of the date of this letter by writing to me at the above address. Please see attached details of the Department for Transport's complaints procedure and your right to complain to the Information Commissioner.from [department] you may ask for an internal review. Your right to complain to DfT and the Information Commissioner

You have the right to complain within two calendar months of the date of this letter about the way in which your request for information was handled and/or about the decision not to disclose all or part of the information requested. In addition a complaint can be made that DfT has not complied with its FOI publication scheme.

Your complaint will be acknowledged and you will be advised of a target date by which to expect a response. Initially your complaint will be re-considered by the official who dealt with your request for information. If, after careful consideration, that official decides that his/her decision was correct, your complaint will automatically be referred to a senior independent official who will conduct a further review. You will be advised of the outcome of your complaint and if a decision is taken to disclose information originally withheld this will be done as soon as possible.

If you are not content with the outcome of the internal review, you have the right to apply directly to the Information Commissioner for a decision. The Information Commissioner can be contacted at:
