I refer to your email dated 16 July 2009 in which you say that `Lincolnshire Police deny that the surveillance vehicle belongs to Lincs Police, we know that, but it was being used by PCW Parker of WLDC ASB team carrying out `investigations' in Tealby in June 2008 contrary to RIPAct (2000)'

Your request for “ Operational log of unmarked vehicle S718HCP used in these operations.”

I again confirm that Lincolnshire Police does not hold this information. This vehicle is not owned or operated by Lincolnshire Police. Lincolnshire Police does not hold an operational log relating to this vehicle. The owner or user of this vehicle may hold the information that you seek.

I refer to your email dated 24 August 2009 in which you say that “You now state that information re the surveillance vehicle may be obtained by the 'owner or user' of the vehicle. The user was your officer WPC Parker”

I will clarify the term `owner or user', as you are aware from the information provided by West Lindsey District Council in reply to your request for information - their reference LM/FOI/480 showed in response to question 1 - `The vehicle in question [S718HCP] was under a leasing arrangement therefore the information requested is not available'

I used the term `owner or user' in the sense that this vehicle is not owned by Lincolnshire Police and that the owner or the user [i.e. the user under a hire contract] would be likely to hold this information.

I did not at any time refer to the driver as the `user'.

I again attach an application form under the provisions of the Data Protection Act to enable you to obtain information about yourself. Please note that personal information is exempt from the Freedom of Information Act and I am unable to provide you with information about yourself under that Act.
