FREEDOM OF INFORMATION REQUEST REFERENCE NO: F-2009-00192

I acknowledge receipt of your email which was received on 29 January 2009 requesting that Lincolnshire Police review its response to your request for information concerning;

1. Kindly supply all reports by officers pertaining to the extensive ASB 'evidence' gathering operations in the Village of Tealby Lincolnshire 2004-2009.

2.Operational log of unmarked vehicle S718HCP used in these operations.

3.Record of 'intelligence' gathered alleging that a resident was banned from a public restaurant. Officers' notes on visit made during that 'investigation'

The reasons for your request are as follows;

Your replies are unsatisfactory. One of your officers (Parker) acting for WLDC ASB Team put me and friends under covert surveillance and secretly gathered `evidence' of my alleged ASB when in fact I was the victim of ASB. This individual lied when giving contradictory accounts of the embarrassing incident when the surveillance vehicle S718HCP was left dangerously parked on the wrong side of the road facing oncoming traffic (photographic evidence available) claiming wrongly that the vehicle was broken down. The same person entered the premises of a restaurant close to my home and told the bemused proprietors that she had `intelligence' that I was banned from the establishment. This was untrue and malicious. I am asking for evidence of this claim.

I have `intelligence' that Parker has recently been making unwarranted `enquiries' about me, and refuses to desist.

Lincolnshire Police has reviewed your request.

  1. Lincolnshire Police provides any information in connection with anti social behaviour to West Lindsey District Council. Much of that information is personal information and is protected by the Data Protection Act.

  1. Lincolnshire Police does not own the vehicle S718HCP and has no information regarding any `operational log'

3 This information and the information provided in your request for a review is personal information and in accordance and the Freedom of Information Act does not apply to personal information. Lincolnshire Police is not obliged to supply the information you have requested. Such information is exempt under section 40 of the Freedom of Information Act 2000. This exemption applies because the right given under the Act to request official information held by public authorities does not apply to personal data - any such requests become subject access requests under the Data Protection Act 1998.

In accordance with the Act, this letter represents a Refusal Notice for this particular request. This action cannot be taken as confirmation or denial that Lincolnshire Police holds the information you have asked for.

Should you wish to know what information (if any) Lincolnshire Police holds about you, or you would like confirmation that you he do, or do not have a prosecution/conviction history, or should you wish to obtain information about you from our local information systems you must complete a Subject Access form.

Payment of a £10.00 fee and proof of identification must accompany a completed application form. Such a form is enclosed.
