Dear Madam,
Re: Legacy Casework Queries
Thank you for your letter dated 25 January 2009. In that letter you requested information under the Freedom of Information Act 2000 about the work of the UK Border Agency to clear the backlog of asylum cases.
How many caseworkers are there in CR Team Liverpool15 at the moment?
How many legacy cases have been allocated to this team by the Case Resolution Directorate?
How many cases has this team resolved so far?
Is this team above or below their target?
The information you have requested above is not held due to the re-structure of the Case Resolution Directorate in January 2009 when CRTL15 was disbanded.
Of the resolved cases how many were grants of leave to remain
As part of the Home Office, the UK Border Agency is not obliged to comply with any information request where the prescribed costs of supplying you with the information exceed £600. The £600 limit applies to all central government departments and is based on work being carried out at a rate of £25 per hour, which equates to 3 ½ days work per request. Prescribed costs include those which cover the cost of locating and retrieving information, and preparing our response to you. They do not include considering whether any information is exempt from disclosure, overheads such as heating or lighting, or disbursements such as photocopying or postage.
I can confirm that we do hold information which you are interested in but have estimated that the cost of answering your request would exceed the £600 limit and we are therefore unable to comply with it. This request would involve a manual search of several thousand case files as this information is not routinely collated.
What measures does this team have to ensure that complex cases
(such as those that have lots of information on file)are not unfairly
left at the bottom of the queue and ignored by caseworkers in favour
of easier cases and smaller files?
The Case Resolution Directorate is dealing with all cases in accordance with the following priorities announced in July 2006 and these are cases involving individuals
who:
May pose a risk to the public;
Can be more easily removed;
Are receiving support from the Agency;
Are likely that a decision will be made to allow an individual to remain in the UK.
The size of a particular file is not taken into consideration when files are selected for processing by the case owner.
If you are dissatisfied with this response you may request an independent internal review within 2 months regarding our handling of your request by submitting your complaint to:
Head of Information Access Team
11th Floor, Short Corridor
Lunar House
Wellesley Road
Croydon
CR9 2BY
During the independent review the department's handling of your information request will be reassessed by staff who were not involved in providing you with this response. Should you remain dissatisfied after this internal review, you will have a right of complaint to the Information Commissioner as established by section 50 of the Freedom of Information Act.
Yours Faithfully
P Edwards
