Dear Mr Johnson

I am writing further to my letter of 5th February 2009, regarding your request for an internal review of the response to your Freedom of Information request for details about who keeps copies of penalty notices issued by Accredited Persons.

I have now completed a full and independent review of this matter and come to the following conclusions.

After consultation with all relevant parties, I have found that your request was initially incorrectly transferred to the MOJ as standard correspondence, rather than treated as a FOI request. I am sorry for this error, and apologise for any inconvenience it has caused.

Once the error had been identified, and the letter passed to the relevant unit in the Home Office, I can confirm that their original decision to inform you that the Home Office does not hold the requested information to be correct. The person who dealt with your original request made enquiries, confirmed that the Home Office does not hold the information, and that this request is now for the Ministry of Justice to deal with. This is because the unit which deals with these matters transferred to the Ministry of Justice (MOJ) in May 2007.

You were provided with contact details for MOJ in a letter dated 4th February 2009 and if you submit your request to them, they may be able to provide you with the information you require. In case you did not receive the letter, these details are:
