FREEDOM OF INFORMATION ACT REQUEST NO 14/2009-0028

1) How many former officers of Devon & Cornwall Constabulary are currently in receipt of an injury award pension, as provided for in the Police Pensions Regulations 1987 and the Police (Injury Benefit) Regulations 2006?

2) Do you operate a policy of reducing an injury award pension to the lowest permissible band when the former officer reaches the age of 65?

3) In the years 2004 to 2008 inclusive, how many former officers' injury award pensions were reduced to the lowest banding upon the former officer reaching the age of 65? (A total figure only is requested, but I have no objection if you break the figures down by year)

4) In the years 1987 to 2003 inclusive, how many former officers' injury award pensions were reduced to the lowest banding upon the former officer reaching the age of 65? (A total figure only is requested, but I have no objection if you break the figures down by year)

5) In the years 2004 to 2008 inclusive, how many formal complaints have been made against officers of ACPO rank in Devon & Cornwall Constabulary regarding matters in any way connected with the administration of reviews of police injury awards? (A total figure only is requested, but I have no objection if you break the figures down by year)

The Human Resources Department have provided the following information:

1) How many former officers of Devon & Cornwall Constabulary are currently in receipt of an injury award pension, as provided for in the Police Pensions Regulations 1987 and the Police (Injury Benefit) Regulations 2006?

There are currently 164 former officers of Devon & Cornwall Constabulary who are in receipt of an injury award pension.

2) Do you operate a policy of reducing an injury award pension to the lowest permissible band when the former officer reaches the age of 65?

The Police Authority has notified the Constabulary of its formal decision to implement the changes within the Police (Injury Benefit) Regulations 2006, which introduced the provision to review all injury awards upon the pensioner reaching the age of 65 in the absence of a cognisant reason. Devon and Cornwall Constabulary are in the process of implementing the change to the Regulations accordingly.

These documents give some details regarding the process in relation to the review of Police Injury Awards.

3) In the years 2004 to 2008 inclusive, how many former officers' injury award pensions were reduced to the lowest banding upon the former officer reaching the age of 65? (A total figure only is requested, but I have no objection if you break the figures down by year)

As above the change to Regulations was not effective until October 2007 so wouldn't have been implemented prior to that date. The Force is implementing this process currently therefore at this time no injury awards have been reduced to the lowest band upon reaching the age of 65.

4) In the years 1987 to 2003 inclusive, how many former officers' injury award pensions were reduced to the lowest banding upon the former officer reaching the age of 65? (A total figure only is requested, but I have no objection if you break the figures down by year)

As detailed above, the changes were not effective until October of 2007, and therefore no injury awards had been reduced during this time.

5) In the years 2004 to 2008 inclusive, how many formal complaints have been made against officers of ACPO rank in Devon & Cornwall Constabulary regarding matters in any way connected with the administration of reviews of police injury awards? (A total figure only is requested, but I have no objection if you break the figures down by year)

As agreed this part of your request was transferred to the Devon and Cornwall Police Authority.
