Dear UK Border Agency,
RE: It is reported that the "The UK Border Agency is to set up a
£4m
"reintegration centre" in Afghanistan so that it can start
deporting unaccompanied child asylum seekers to Kabul from Britain"

and will consider your response, can I also request how many
expressions of interest have been made to date and the date you
expect to award the Tender.
As a serious concern you mention the UK Border Agency is planning
to take children out of being under the care or looked-after under
the Children Act (1989) and that placing them in a facility and not
with their family in Afghanistan would "per se" be compatible with
compatible with the Children Act or UN Convention on the Rights of
the Child. Since the UK reservation on the UN Convention, the UK
can no longer assume that immigration laws supersede it or domestic
child care law and principles.
The proposals may only compatible, so long as it can be shown to be
in the Best Interests of each individual child and is undertaken
through each individual child's Informed consent.
I have not seen anything published by the UK Border Agency that
suggests it has the capacity or lawful duty to assess such issues
of Informed consent or Best Interests. I therefore conclude the
feasibility or success of these proposals is per se outside of the
control of the UK Border Agency and possibly the organisations it
seeks collaboration with on these proposals.
You say:

serious organisation that believes that returning children to their
own countries"
This must mean that organisations like The Medical Foundation for
the Care of Victims of Torture, which has said there are "Grave
risks..." for these proposals and surely it must be per se be a
"serious" organisation you are aware of.
