Freedom of Information Request Reference No: 165-08-647
On 11th December 2008 you made a Freedom of Information request to Surrey Police
and following an extension of the response period you were provided with the
response on 18th March 2009. On 19th March 2009 you requested us to review that
response and I can advise you that the Surrey Police FOI Appeals and Complaints
Panel have now completed its review.
Your request states …..
“I am seeking information on anthrax or white powder hoaxes utilizing the postal
system in 2003”.
The appeals panel has reviewed your request and the original decision made by the
Information Access Team. We find that the Freedom of Information Act has been
applied correctly and support the explanation and their response to your request, other
than that we wish to add the following paragraph.
There was a mistyping in that Section 31(3) was applied although Section 31(1) was
what was written – apologies for that. In addition however we wish to apply Section
40(5) of the Act: were information of this nature to be held then it would contain
personal data which would not be disclosable.
It must always be considered that disclosure of any information under the Freedom of
Information Act is a disclosure to the public at large, not to any individual requestor.
As stated in the original request, to confirm or deny that Surrey Police had recorded
incidents of this nature, other than the one in the public domain, would potentially
harm criminal investigations.
