Firstly allow me to apologies for the delay in response to you request. The information that you requested is a follows:

  1. What is the criteria you use for judging these claims

All grievances and complaints are investigated according to the Council's policy and procedures.  Complaints to the Employment Tribunal are judged by the Tribunal, not by the Council.

  1. What the scale of damages payable is

We do not hold this information as this is decided by the Employment Tribunal, not by the Council.

  1. Where the Council would accept liability

        It would depend on the circumstances of each individual case.

  1. Whether the Human Rights act was brought into any of these cases, if so how was it used.

The Council does not hold the specific information you require. Under the terms of the Freedom of Information Act 2000, The Council is only obliged to provide information if it already exists in a `recorded' format e.g. in writing, held on electronic or magnetic media e.g. computers or tapes. Regrettably we are unable to assist you any further in respect of this specific request fir information.

  1. How many were successful.

There were no successful constructive dismissal claims at tribunal.

  1. What were the results of the successful claims? eg damages.

        No damages were paid (see response to point E).
