Dear Mr Derby,
Thank you for your e-mail of 18 February to the Driver and Vehicle Licensing Agency (DVLA) about untaxed foreign vehicles and asking for an Internal Review of your Freedom of Information (FOI) request. [Author ID1: at Fri Feb 20 12:26:00 2009 ]
I should explain that your original FOI request of 6 December was not dealt with as such but was dealt with as a routine day to day business request and you were provided with a comprehensive response on 18th December 2008. It is unfortunate that it was not made clear in that correspondence that your request was being dealt with in such a way and I can only apologise for that. You have said that you sent a further e-mail dated 30th December 2008 asking for further information and that you did not receive a response to that e-mail. Having conducted an extensive search of all relevant e-mail inboxes, I can find no trace of your e-mail dated 30th December 2008 being received and that is the reason why you did not receive a response.
As your initial request was not dealt with as a FOI request and your subsequent e-mail was not received, I am of the opinion that an Internal Review under the FOI Code of Practice's complaint procedures is inappropriate in the circumstances. As such no Internal Review will be undertaken into your request as it is felt that your initial request was answered in full, albeit not as a FOI request, and that we have no evidence of receiving your subsequent e-mail. However, having now had the opportunity to give consideration to your e-mail of 30th December 2008 I can now provide you with relevant information. I should point out that the request contained in that e-mail is also being dealt with as routine day to day business and not under the provisions of the Freedom of Information Act.
The information that you have now requested is as follows, as of today's date there are a total of 14,664 sightings of foreign registered vehicles in Great Britain having been logged at the Agency in the last twelve months. Of these there are a total of 8657 that are eligible for direct enforcement action i.e have exceeded the six month ruling. The actual number of vehicles having had direct enforcement action carried out against them in the last twelve months is 219.[Author ID1: at Fri Feb 20 12:26:00 2009 ]
