Re: Internal Review of Freedom of Information Request - Bullying & Harassment

Thank you for your response to the Council's reply dated 17 December 2009 to your Freedom of Information request.

  1. As indicated we do not have a system which records reasons for sickness absence. Our payroll systems can give information about levels of sickness absence but cannot report on reasons. The only way to answer your question would be to manually trawl through paper records sent by managers for each instance of absence for 13,000 staff over the 4 year period in question. I cannot authorise this work without charging a substantial fee. If you still wish to pursue this information I will supply a charge for this work.

2.&3. The Council does not employ a Welfare Officer. Support on stress, anxiety, depression or any combination of these ailments is often initiated by the HR Officers. At the time your enquiry relates to there were 5 separate service group teams. Some of these cases would have triggered counselling support but by no means all, so the route you suggest would not produce the number of cases of stress, anxiety or depression.

The answer to your question about how many employees have claimed constructive dismissal for bullying and harassment or filed any other claim on these grounds was perhaps not as clear as it could have been in the Council's previous answer, but the total claims against the City in the Employment Tribunal for bullying/harassment is 4. None were for constructive dismissal.

I hope this letter provides some clarity on the bullying and harassment cases and explains why the Council cannot answer the question about absence on grounds of stress, anxiety or depression.
