Dear Ms Gray
Freedom of Information Act Request re Bullying and Harassment.
Thank you for your request received in this office on 4th December 2008.
Using the order of your original request the information you requested is:
To clarify, the responses provided by the Authority are following the introduction of a new HR database in February 2008.
133 cases of absence between February 2008 to 31st October 2008. We do not hold accurate recorded information for reasons for absence up to February 2008.
1 case of bullying since February 2008. We do not hold accurate recorded information for complaints of bullying up to February 2008. By its very nature bullying tends to be not so clear cut in its definition, it tends to be part of a wider grievance.
1 case claimed of constructive dismissal since February 2008. This case is ongoing.1 case relating to “undermining management style” was recorded in March 2007. Prior to this, types of grievance were not logged, only levels of grievance.
1 case in March 2007, the aforementioned constructive dismissal grievance on 'undermining management style' was lodged with the Employment Tribunal, but withdrawn prior to the Hearing. There was a second unfair dismissal case in October 2007 where bullying was cited as part of the claim, but again this was withdrawn prior to the Hearing. Both parties withdrew their claims prior to their cases being heard at the Employment Tribunal.
If you have any complaints in respect of your information request, the Council does have a complaints procedure which includes requests specifically relating to the Freedom of Information Act. If your complaint is not resolved by the Council's
procedure, you have a right under S50 of the Act to apply to the Information Commissioner for a further review of the matter by writing to the Information Commissioner's Office, Cambrian Building, Mount Stuart Square, Cardiff CF10 5FL.
Yours sincerely
Neil Bennett
Head of Information and Cultural Services.
