Freedom of Information Act 2000- Review (CE7-134)

Dear Ms Gray

I am writing in respect of your request for a review of the Authority's decision with regard your Freedom of Information request. You originally made the following request:

1. I would like to know how many employees of the city council have been absent from work due to either stress, anxiety, depression or any combination of those ailments between 1st August 2004 and 31st October 2008.

2. Please also confirm how many complaints of bullying have been made by employees of the council against managers or colleagues during the same period.

3. Please confirm how many employees have claimed constructive dismissal within the same period for bullying/harassment.

4. Please confirm how many claims have been filed against the city council at the Employment Tribunal within the same period for bullying / harassment.

The FOI Officer's response dated 13 January 2009 stated that the Council held some of the information that you required, however, for the period prior to October 2007 the Council estimates that the cost of complying would exceed the appropriate limit of £450. The information that you required post October 2007 was fully passed to you.

You have been provided with a response to your questions 2, 3 & 4 previously.

Your request was reviewed on 12 January 2009 by me as Corporate Complaints Manager and Sharon Heys, Solicitor.

The review established that the Council holds some of the information that you require, however for the period prior to October 2008, the cost of complying would be in excess of the appropriate limit of £450. The appropriate limit, is set in regulations made under section 12 of the Act and represents the estimated cost of one person spending two and a half working days (25 hours charged at £25 per hour) locating, retrieving and compiling the information requested.

I am satisfied on review, on consideration of the information provided to me by the relevant department, that the time estimate provided is accurate and that the costs limit is exceeded. The criteria under section 12 are therefore made out and the Council is not obliged to process your request further. The Authority is therefore declining to deal with your request unless you are in a position to refine the information you require.

If you are unhappy with the above determination, you can appeal against this determination under S50 of the Act to the Information Commissioner who can be contacted at the Information Commissioner's Office (Wales), Cambrian Buildings, Mount Stuart Square, Cardiff, CF10 5FL.
