REQUEST FOR INFORMATION: PRIVATE TENANTS' AND LANDLORDS' ORGANISATIONS

Thank you for your e-mail of 2 June 2010 in which you asked to be provided with the following information:

Your request has been considered under the Freedom of Information (FOI) Act 2000.

Unfortunately it will not be possible to provide you with the information you have requested. This is because we estimate the cost of determining what information falling within the scope of your request the Department holds and locating, retrieving and extracting it would exceed £600. Under section 12(1) of the FOI Act the Department is not obliged to comply with a request for information where the cost of complying would exceed the appropriate limit, set out in the FOI and Data Protection (Appropriate Limit and Fees) Regulations 2004 at £600 for a government department.

It may be possible to provide you with some of the information you have requested within the appropriate limit of £600. If you would like to make a request for just some of the information then I will be able to tell you what this would cost to provide. If you would like more information about Communities and Local Government's structure of fees for providing information, this can be found on our web-site at: http://www.communities.gov.uk/corporate/foi/requests-information/fees/

As an organisation we aim to be as helpful as possible in the way we deal with requests for information under the FOI Act. If, however, you are not satisfied with the way in which your request has been handled or the outcome, you may request an internal review within two calendar months of the date of this letter. Information about the Department's review procedures and how to apply for an internal review of your case can be found on the Department's website at http://www.communities.gov.uk/corporate/foi/foicomplaints/. This also explains your right to apply directly to the Information Commissioner for a decision in the event that you remain dissatisfied following the Department's review.

Generally, the ICO cannot make a decision unless you have exhausted the internal review procedure provided by this Department. The Information Commissioner`s address is in the leaflet referred to above.
