Thank you for your request for information which was received by the Isle of Wight Council on 9 July 2010 and which has been considered under the provisions of the Freedom of Information Act 2000.

Please find attached a document containing the details we will disclose to you. We are not required to hold the names of the owners only the name of the liable party responsible for the payment of Business Rates, which has been included in the information supplied to you.

Some of the information you have requested is considered personal information where the name of the liable party is an individual or sole trader and is therefore exempt under section 40 of part ll of the Act.

The personal information that has not been provided is exempted from disclosure by virtue of section 40(2) of the Freedom of Information Act 2000. It is the council's belief that the release of this information would be likely to breach the first principle of the Data Protection Act 1998 and is therefore exempt from release. The council believes that there would be a legitimate expectation by the data subjects that their personal details would not be released and the individuals in question have not consented to the disclosure of their details. It further believes that the release of the same information would therefore be unfair to the data subjects.

The Isle of Wight Council in complying with their statutory duty under sections 1 and 11 of the Freedom of Information Act to release the enclosed information, will not breach the Copyright, Designs and Patents Act 1988. However, the rights of the copyright holder of the enclosed information will continue to be protected by the law. If you wish to use this information, you may require approval or licence from the copyright holder.

Most of the information that we provide in response to Freedom of Information Act 2000 requests will be subject to copyright protection. In most cases the copyright will be owned by the Isle of Wight Council. The copyright in other information may be owned by another person or organisation, as indicated on the information itself.
