3-10-04EN landlord of Kingston Great Common NNR erected fence on the boundary without obtaining S28E consent and in breach of tenant/landlord lease.Erection of fence posts with barbed wire was undertaken to clearly mark the boundary of the NNR following the owner's appeal against the provisional map of open country and registered common land under Part 1 of the CRoW Act 2000. No notice was given for the works by the owner/occupiers which is legally requires under Section 28E of the Wildlife and Countryside Act 1981 (as substituted by Schedule 9 to the CRoW Act 2000). As these works were in contravention of section 28E of the Act, an offence had been committed by the owner. Believed to be a one-off offence.The erection of the boundary fence was considered an operation likely to damage land within the SSSI.Investigation began 04/05/04. Owner pleaded not guilty to causing damage to a SSSI on the 22/07/05 at Lyndhurst Magistrates Court and opted for the hearing to be heard at Southampton Crown Court. Prosecution heard at Southampton Crown Court 31/01/06 - 17/02/06. Jury returned verdict of not guilty. EN awarded costs.n/an/a Given court verdict
7-8-05A party was held on common land over the weekend of the 8-10/ 07/05. Two bonfires were lit on lowland heathland area of the SSSI.There was minor damage although this was a re-occurrence of non-compliance.Vegetation will recover.File of correspondence in Lyndhurst office. Requested landowner to engage with NE to prevent the gathering and in particular fires happening again as this was the third year in a row that the gathering had occurred.clearing of rubbish by landowner

The unimproved meadows (MG5 M23) were notified as this habitat type under significant decline (1996). Sward likely to recover over long term but unknown recent diversity before. Last surveyed 1998. Will be dependent on source of reseeding. Scrub vegetation around the fence will recover in a few years.Enforcement letter sent 23/05/07. Site visited by NE 22/06/7 from adjacent land. Further investigations with Environmental Impact Assessment Team, potential breach of EIA (Agriculture) (England) (No. 2) Regulations 2006. n/aAllow to recover naturally with suitable levels of grazing.
