FREEDOM OF INFORMATION
Thank you for your freedom of information request of 11 November 2008, received by us on 11 November 2008. This gave a statutory deadline for responding of 10 December 2008 under the terms of the Freedom of Information (Scotland) Act 2002 (FOISA).
Under section 25 of the Act, we are not required to provide information in response to a request if it is already reasonably accessible to you. The information you requested in relation to the tariffs for use of the inmate telephone in the Scottish Prison Service is available from the BT Web Site at the following Web address.
If you do not have access to obtain this information from the website listed, then please contact me again and I will arrange to provide it in hard copy.
This information has not changed significantly over time and the tariffs include VAT. The only change that I am aware of to the tariffs is that of the recent VAT rate change, to 15%, which came into effect on 1 December 2008. Prices before 1 December were calculated at 17.5% VAT. Tariffs are not included on the SPS bills and as such copies of bills have not been provided.
You also asked for a copy of the current contracts with the telecoms provider for the inmate telephone system. Section 36(2) of the FOISA allows an exemption provided that the confidentiality clause when entered into was prior to FOISA. The information you have requested is subject to a pre-existing confidential agreement which was in place before introduction of FOI legislation. Our suppliers have advised SPS that they do not wish us to release any copies of the contract which means, on this occasion, this part of information you requested is exempt from disclosure.
If you are dissatisfied with this response, you have the right to request a review. Your request should be made within 40 working days of the date of receipt of this letter and we will reply within 20 working days of receiving your request. Under section 20(3)(c)(ii) of the Act your request should outline your reason for seeking a review. If our decision is unchanged following a review and you remain unsatisfied with this, you then have the right to make a formal complaint to the Scottish Information Commissioner.
