Dear Mr Agar,

Request for information RFI/02237

Thank you for your e-mail dated 1 July 2010 in which you requested:

I am looking to obtain details on the location of council owned housing estates in the London Borough of Greenwich. Ideally I would prefer a map that shows clearly the defined area of each estate which would probably be something held by a GIS team on ArcView or MapInfo type products.

I would be very grateful if you could supply a map of this information naming the estates..

I can confirm that the Council holds this information, however, the information is exempt under section 21 of the Freedom of Information Act which states:

  1. Information which is reasonably accessible to the applicant is exempt

Information.

  1. for the purposes of subsection (1)

(a) information may be reasonably accessible to the applicant even though it is accessible only on payment; and

(b) information is to be taken to be reasonably accessible to the application if it is information which the public authority or any other person is obliged by or under any enactment to communicate (otherwise than by making the information available for inspection) to members of the public on request, whether free of charge or on payment

This information is accessible to you as a routine request but because the Council is obliged by the Mapping Services Agreement (as extended) or under any enactment to communicate to members of the public under request, this information on payment.

It is on this basis that the Council will provide the information to you but for a fee. In this case a fee of £10 is payable to us before I can provide you with the information. This charge is to cover the cost of production and dispatch. The cheque should be made payable to Greenwich Council and should be sent to Geographic Information Services at the above address.

We are unable to continue processing your request until the fee is paid. Once the Council is in receipt of your fees we will then provide you with the information.

If you are dissatisfied with the handling of your request, you have the right to ask for an internal review. Internal review requests should be submitted within two months of the date of receipt of the response to your original letter and should be addressed to:-

Mary Ney, Chief Executive, Town Hall, Wellington Street, Woolwich, London, SE18 6PW

Please remember to quote the reference number above in any future communications.

If you are not content with the outcome of the internal review, you have the right to apply directly to the Information Commissioner for a decision. The Information Commissioner can be contacted at: Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF.

Yours sincerely

Peter Young
