Dear Councillor Allan Pennington, Mayor of Prestatyn and Meliden,
Please could you pass this on the the person/s dealing with Freedom
of Information Act requests?
Could I chase up a previous F.O.I.A request concerning my own
F.O.I.A. Requests to Prestatyn/Meliden Town Council?
As the original question by Allan Warrington wasn't answered. I
understand the Ombudsman for Wales was involved and gave some
guidance on how to deal with requests (below)
It is with this in mind could I formally ask for the original
questions to be answered. As I was the subject of Prestatyn and
Meliden town Council part two agenda.
1) Could it be confirmed the total price to Prestatyn Town of Mr.
Bourne's F.O.I.A. Requests?
2) Could the method of arrival at this total figure be explained?
3) Could the total number of requests be given, plus any requests
that required a second or third question to explain previous
answers?
4) Are there any present (being dealt with) or past (resolved)
Information Commissioner Office complaints against Prestatyn Town
Council and it's compliance with the F.O.I.A.?
5) I understand you have been quoted in the paper as having 15
years experience working at Prestatyn Town Council?
a) Could I therefore ask for the total number of F.O.I.A. Requests
you have dealt with on a year by year break down?
Yours sincerely

Dear Sir/Madame,
Could I make a complaint concerning Prestatyn Town Councillor
Anton Sampson, Deputy Mayor of Prestatyn and Prestatyn Town
Council/Denbighshire County Councillor Allan Pennington Mayor of
Prestatyn?
I name the original request for a Freedom of Information Request
concerning Labour Councillor Peter Duffy being quoted from a part 2
Prestatyn Town Council meeting. Mr. Bourne has cost Prestatyn Town
Council £400 from his Freedom of Information Requests. In its self
the information was presented to Prestatyn Town Council by the Town
Clerk Mr. Nigel Acott.
While intrinsically there has been no reply at all from Prestatyn
Town Councillor Anton Sampson, deputy mayor of Prestatyn and
Prestatyn Town Council/Denbighshire County Councillor Allan
Pennington Mayor of Prestatyn and Mr. Nigel Acott. I believe under
the Freedom Of Information Act and the Code of Conduct. I'm
entitled to at least a reply if not the information itself or an
explanation to why it is being withheld.
I believe under section Preventing Access to Information Para
5(b):-
You must not prevent any person from accessing information which
they are entitled to by law. This includes information under the
Freedom of Information Act 2000 or those copies of minutes,
agendas, reports and other documents of your authority which they
have a right to access. To find out more about what types of
information the public can access, contact the Information
Commissioners Office by visiting www.ico.gov.uk or by calling 0845
630 6060 for specific queries, you should ask your monitoring
officer or clerk.
Any information that you produce in your official capacity is
liable to be subject to the disclosure requirements of the Freedom
of Information Act, and your authority may be required to release
it in response to a request. If you do not provide the information
to the relevant officer of your authority on request you will be in
breach of the Code.
Your authority needs to decide whether to disclose information or
whether it may be covered by an exemption. Even if you believe that
information you hold is exempt, you must provide it to your
authority's relevant officer to allow the authority to reach a
decision. As well as being a breach of the Code, it is a criminal
offence if information is destroyed after a Freedom of Information
request has been received.
Yours sincerely
ALAN WARRINGTON
