We refer to your request dated 26 October 2008 for the number of planning applications called in by Scottish Ministers since May 2007 and the number of letters of objection received for each. We have dealt with your request in terms of the Freedom of Information (Scotland) Act 2002 (FOISA) and Environmental Information (Scotland) Regulations 2004.

The number of planning applications called in by Scottish Ministers between 1 May 2007 and 26 October 2008 is 25. We do not hold the information, in the form that you are looking for, in relation to the number of objections received by Scottish Ministers for each case. The table below is an approximation of the numbers of objections received overall, including those provided to the relevant planning authority.

Although Scottish Ministers have the power to call-in planning applications for their own determination they will continue to respect the important role of planning authorities in making planning decisions, and will exercise this power to intervene in the process only where they consider such action necessary. Further information on this can be found in the Scottish Government's Planning Circular 5/2007: Notification of Planning Applications, available at: http://www.scotland.gov.uk/Publications/2007/04/30162614/0. The circular notes that a substantial number of objections is not, in itself, sufficient ground for call-in.

If you are unhappy with this response to your request, you may ask us to carry out an internal review, by writing to Dr Andrew Goudie, Director General Economy, Scottish Government, Victoria Quay, Edinburgh, EH6 6QQ. Your request should explain why you wish a review to be carried out, and should be made within 40 working days of receipt of this letter, and we will reply within 20 working days of receipt. If you are not satisfied with the result of the review, you then have the right to make a formal complaint to the Scottish Information Commissioner.
