FOI Reference: 150/2009
Request:
[1a] the total number of homophobic hate crimes reported to you in
the last year
[b] the last three years
[2a] the total number of those hate crimes that were reported to
the Crown Prosecution Service in the last year
[b] the last three years.
Clarification:
I am seeking information on calendar year, and would appreciate the
information as soon as possible.
Response:
1. (a)(b) I can confirm that Dyfed-Powys Police does hold the information requested the
details of which are outlined below:
2008
Homophobic Hate crimes = 28
2007
Homophobic Hate crimes = 17
2006
Homophobic Hate crimes = 35
Response:
2. (a)(b) The cost of providing you with all of the information is above the amount to which we
are legally required to respond i.e. the cost of locating and retrieving the information exceeds
the “appropriate level” as stated in the Freedom of Information (Fees and Appropriate Limit)
Regulations 2004. It is estimated that it would exceed 18 hours (i.e. minimum of 20 hours) to
comply with this part of your request. The regulations can be located @
www.legislation.hmso.gov.uk/si/si2004/20043244.htm.
It has been calculated that there are 80 records held which may contain information
applicable to the request. In order to retrieve and collate the information requested would
require opening and researching each and every record. Going on the estimate that it would
take a minimum of 15 minute to research each record, to complete the task would take a
minimum of 20 hours.
Accordingly, applying the same principle the following time estimates have been calculated
for the following years:
In 2007 there were 17 records x 15 minutes = 4.25hrs
In 2006 there were 35 records x 15 minutes = 8.75hrs
In accordance with the Freedom of Information Act 2000, this letter acts as a Refusal
Notice for this request. However, you may wish to refine and resubmit your request so that
it reduces the time shown above to fall within the 18 hours. Please contact me if you would
like some advice on refining your request.
It should be noted that as a result of the systems adopted by Dyfed-Powys Police in
relation to the recording of such information that the information released may or may
not be accurate
Furthermore, it should also be noted that Police forces in the United Kingdom are
routinely required to provide crime statistics to government bodies and the recording
criteria is set nationally. However, the systems used for recording these figures are
not generic, nor are the procedures used locally in capturing the crime data. It should
be noted that for these reasons this force's response to your questions should not be
used for comparison purposes with any other response you may receive.
