Many thanks for your letter and for your interest in the Member’s Bill which I am pursuing in 
Holyrood. 
  
I am certainly aware of the need to ensure that HIV status is included in the definitions used in the 
Bill and have had discussions with HIV Scotland and others to address this.  I will ask the Bill team 
to reply separately to explain how this issue has been addressed in the drafting of the Bill. 
  
We have been given a disappointingly long timescale for parliamentary progress, with Stage 1 
continuing until perhaps as early as next April.  However, this additional time means that we can 
ensure that any outstanding issues can be dealt with before we reach Committee.  If you would like 
to meet to discuss the Bill’s application to HIV, please don’t hesitate to contact my office.

Many thanks for the update. I will of course keep you posted with any requests I receive.  I will also be 
meeting with the supporting organisations to keep everyone up to date with the current position, and to 
discuss the approach to committee scrutiny. 
  
Meanwhile I have replied to a letter from the National AIDS Trust, in which they raise concerns about whether 
HIV status will be covered by the Bill.  I have assured them that we have considered this and that we believe 
that HIV status will indeed be covered, however I would be grateful if you could take a look at the letter and 
see if there's anything else you or other officials would like to add.  If you have a fax number, I will ask my 
office to send you the letter.

I hope this finds you well.   
Now that the Bill has been allocated to a Committee, I thought I would just give you a quick 
round up of where we stand and our understanding of the current situation.  The Clerks to both 
the Justice and Equal Opportunities Committees have been in touch already.  As secondary 
Committee, the Equal Opportunities Committee is likely to consider the general principles of 
the Bill and look in particular at the possibility of including age and gender related 
aggravations.  (This has not been finalised yet.)  It will then provide the Justice Committee 
with a report of its findings.    The Equal Opportunities Committee has asked to see officials 
informally for a factual briefing on 2 September.    The Justice Committee will also probably 
want an informal briefing towards the end of the year or even in early January and is looking 
to begin formal consideration of the Bill in the second week of January in order to have stage 1 
complete by 3 April 2009.  It will likely be Andy, me and lawyers who attend these briefings.  
I will keep you posted on any requests for appearances by Mr MacAskill.  It would be helpful 
to us to know when you have been asked to appear and we are of course happy to provide any 
and all support you may want.    
Mr MacAskill wrote today to the Convener of the Justice Committee, copied to the Convener 
of the Equal Opportunities Committee, enclosing the Executive Memorandum on the Bill.

Ministers are invited to submit an Executive Memorandum on any Member’s Bill setting out 
Scottish Government views on the Bill and how it should be handled.  Obviously in this case, 
the Memorandum is very short and simply reiterates that we have supported you in the 
production of the Bill and Accompanying Documents and that as such, the Government 
endorses both the Bill as introduced and the information contained in the Accompanying 
Documents. 
I plan to ask my Division Head to authorise publication of our Equalities Impact Assessment.  
It should go live on the Government website in the next few days.
