REQUEST FOR INFORMATION
We refer to your request for information under the Freedom of Information Act
(FOIA) received by the Olympic Delivery Authority (ODA) on 7 October 2008
requesting the following information:
Could you please let me know:
1. what are the terms of reference for the KPMG study on
the Olympic venues, and
2. when you expect the study report to be in.
We confirm that we hold information of the description specified in your
request.
Item 1
In terms of section 2 of the FOIA, the duty of a public authority to give access
to information does not apply in respect of information which is exempt under
the FOIA. section 41 of the FOIA exempts information from disclosure if:
1. The information was obtained by the public authority from any other person
(including another public authority), and
2. Disclosure of the information to the public by the public authority holding it
would constitute a breach of confidence actionable by that or any other
person.
The full terms of reference for the engagement of KPMG is held by the ODA
on explicit and/or implicit terms that make it subject to a duty of confidence.
We consider that disclosure of this information would constitute a breach of
confidence actionable by a third party or third parties. We regret that we are
therefore unable to communicate the information to you.
However, the ODA understands the importance of acting in an open and
transparent manner and acknowledges that the public has a legitimate interest
in the work of the ODA. Accordingly, we would advise you that KPMG was
instructed by the ODA with input from the Department for Culture Media and
Sport (DCMS) to assist in the evaluation of the options analysis for:
• Venue options for Basketball which would include the final round of the
Handball Competition;
• review of the value engineering study conducted by the ODA in late
2007;
• the use of the Royal Artillery Barracks at Woolwich as the venue for
both the Olympic and Paralympic Games Shooting competitions;
• the use of Greenwich for the Equestrian and Modern Pentathlon
events during the Games;
• the use of Eton Manor as the possible venue for Wheelchair Tennis,
Paralympic Archery and training pools.
In order for KPMG to carry out its obligations, it held discussions with the ODA
and LOCOG as well as conducting interviews with key stakeholders. KPMG
was also provided with additional information in relation to each of the above
points in order to assess the project status, potential alternatives and reasons
for discounting alternate possible venues.
Item 2
The KPMG report with its recommendations will be presented to the Olympic
Board in late 2008 – early 2009.
