In response to your request we can confirm that the Information Commissioner's Office does monitor public authorities' conformity with part VI of the section 45 Code of Practice, which pertains to complaint procedures (internal reviews).

We can also confirm that we hold, and are pleased to provide, information of relevance to your request. This can be found in part (3) of this response.

(1) The Commissioner's approach to monitoring

It may be helpful if we begin by explaining a little of the background to our monitoring activity.

The Commissioner's monitoring of public authorities' approach to internal reviews is primarily informed via the complaints made to his office (section 50 of the Freedom of Information Act 2000 and Regulation 18 of the Environmental Information Regulations 2004). When incidences of non-conformity with part VI of the section 45 Code are identified, they are logged by his Good Practice and Enforcement Team. Examples of non-conformity with part VI of the Code typically consist of delay (with emphasis upon responses which exceed the Commissioner's recommended timeframes); the operation of complaints procedures with more than one stage or the failure to conduct a thorough internal review. We also record incidences of an authority failing to conduct a review altogether.

Monitoring of non-conformity with part VI of the section 45 Code has taken place since the inception of the FOI Good Practice and Enforcement Team in July 2006. This team has responsibility for identifying patterns of non-compliance arising from requests made under the Freedom of Information Act 2000 (the `Act') and the Environmental Information Regulations 2004 (the `Regulations'). The FOI Good Practice and Enforcement Team is also responsible for monitoring non-conformity with the associated Codes of Practice.

Initial monitoring of internal reviews was restricted on account of the limited resources available; however in 2008 the FOI Good Practice and Enforcement Team was expanded, allowing us to carry out wider observation of both compliance with the Act / Regulations, and conformity with the associated Codes of Practice.

As you may already be aware, the Commissioner has made several public recommendations to authorities who have failed to conduct internal reviews in accordance with part VI the section 45 Code of Practice. Each of these practice recommendations is available online via the links below.

In addition to practice recommendations, the Commissioner may make reference to internal review procedures which fail to conform with part VI of the section 45 Code of Practice within Decision Notices. Where possible, we have undertaken to provide examples of Decision Notices which make reference to non-conformity with part VI as part of the information we have released to you in response to your request (please see part (3)).

Since the publication of the Commissioner's Good Practice Guidance No. 5 in February 2007, there has been renewed scrutiny of authorities' conformity with part VI of the section 45 Code of Practice and where it is clear that an authority has exceeded the Commissioner's recommended timescales, we will endeavour to inform them of this.

In cases where serious, repeated or systemic failures to conduct an internal review in accordance with part VI of the section 45 Code of Practice are identified, the FOI Good Practice and Enforcement Team will consider whether regulatory action, such as a practice recommendation, is appropriate.

(3) Authorities brought to the FOI Good Practice and Enforcement Team's attention


Annexe one contains a list of authorities which we consider to have failed to conform to part VI of the section 45 Code of Practice in one or more of the complaints brought to the Good Practice and Enforcement Team's attention.

The list includes the following information:

The name of the public authority; a shorthand version of the ICO's reference number; the date on which the Good Practice and Enforcement Team received notification of the issue; the date of the original FOI request to the authority; and a brief summary of the issues arising in respect of the internal review. In cases where we are aware of a published Decision Notice which refers to non-conformity with part VI of the section 45 Code of Practice, we have included a web-link.

We have arranged the list into alphabetical order for ease of reference. It may be helpful if we explain that for the most part, the data in the spreadsheet represents the situation at the time the information was captured. For example, you may notice that some of the entries state that the internal review remains outstanding, and this reflects the circumstances at the time of the entry rather than the current status.

We would also like to take this opportunity to explain that, since their addition, it is possible that a number of the authorities included in the list have proactively adopted the recommendations made in the Commissioner's Good Practice Guidance No.5, and as such their inclusion does not necessarily denote ongoing problems.

As you will see from the information contained in annexe one, the FOI Good Practice and Enforcement Team has not intervened in every case brought to its attention. Rather, a decision is taken as to whether intervention is appropriate in accordance with the FOI Enforcement Strategy.

You may also be interested to know that as well as structured intervention, advice on internal reviews is also dispensed on an ad-hoc basis, via responses to verbal and written enquiries and throughout the complaint investigation process. For example, if we receive a complaint which suggests that an authority has failed to conduct an internal review in a timely fashion, our Case Reception Unit will write to the authority to outline our expectations and to bring Good Practice Guidance No. 5 to its attention. This means that in practice, many more authorities are aware of the Commissioner's expectations than those listed here.
