Re: - Request for Information
I refer to your request for a review of the Business Rate Manager's decision not to supply the information, requested on 1 May 2010, in connection with the property at 258 Deansgate Manchester M3 4BG. I apologise for the delay in responding to your request. You requested-
“1) Details of any mandatory or discretionary relief from non-domestic rates which has been applied at any time over the past 5 years to 258 Deansgate, Manchester M3 4BG.
2) If such relief has been applied, please provide:
- a copy of the application and all documents supplied in support
of it.
- the reasons behind the Council's decision to apply the relief”.
There are two rating assessments in the list where the address includes 258 Deansgate. These are described as 258-260 Deansgate. One assessment is in respect of the Basement to 3rd floor and the other, 4th & 5th floors.
I have assumed that your reference to mandatory relief refers to relief granted under Sections 43(6) or 45(6) Local Government Finance Act (LGFA) 1988 (Charitable organisations) and your reference to discretionary relief refers to relief granted under Section 47 LGFA 1988. This means that I have not included details of any relief given under Section 47 LGFA 1988 (where relief is given purely because a property is unoccupied).
I believe the information you requested in 1) should be supplied and consequently I confirm that at no time over the past five years has mandatory or discretionary relief been awarded in respect of Non Domestic Rates at these two assessments. As relief has not been applied part 2) of your enquiry requires no response.
