Request for Information – Release of Information under the Freedom of Information (FOI) 
Act 2000  
 
I am writing to provide you with an update on your request for the annual reports from the 
Defence Nuclear and Environment Safety Board to the Defence Environment and Safety 
Board for the years 2006-7, 2007-8 and 2008-9.  
 
As you wil  be aware from my earlier letters, qualified exemptions S24 (National Security), 
S26 (Defence), S27 (International Relations) and S35 (Formulation of Government Policy) 
of the FOI Act are believed to apply to the information that you have requested.  These 
qualified exemptions are subject to the application of a balance of public interest test. 
 
I am afraid that this work is taking longer than anticipated.  As a result, we are not yet in a 
position to be able to provide you with a final response.  We hope to conclude this work 
within the next 20 working days; I wil  therefore write to you again by 27 September 2010. 
 
If you are not satisfied with this response or you wish to complain about any aspect of the 
handling of your request, then you should contact me in the first instance. If informal 
resolution is not possible and you are still dissatisfied then you may apply for an 
independent internal review by contacting the Head of Corporate Information, 6th Floor, 
MOD Main Building, Whitehal , SW1A 2HB (e-mail [email address]). Please note that 
any request for an internal review must be made within 40 working days of the date on 
which the attempt to reach informal resolution has come to an end.  
 
If you remain dissatisfied fol owing an internal review, you may take your complaint to the 
Information Commissioner under the provisions of Section 50 of the Freedom of 
Information Act. Please note that the Information Commissioner will not investigate your 
case until the MOD internal review process has been completed. Further details of the role
