Please find attached the first draft of the “options paper” we discussed before
Christmas. Apologies for the delay but the ICO has been active closing off
cases in the period before Christmas which proved a bit of a distraction. I
anticipate it will need some refinement and discussion and input from your
selves.
Clearly the legal advice expected by the end of the month by both MoJ/Defra
and TNA will affect exactly what we say, hence despite the introduction
referring in square brackets to recommend options, it may be worth waiting
what our legal room for manoeuvre is before completing that part.
In the first instance I suggest you send views and comments by e-mail and I
can put together a second iteration which we may wish to meet and discuss.

The principle of internal re-charge is central to the requirements of CPSR
with regard to access to un-refined data to compile search products for which

re-use arrangement.

Please find enclosed the Information Tribunal’s Decision Notice. The Tribunal
has found in favour of the Information Commissioner. We do not know if the
Council will appeal to the Upper Tribunal. It was only promulgated yesterday
(15 March) and is not yet on the Tribunal’s website.
