Re: Freedom of Information request number 1687

Thank you for your request for the following information:

1. Do Refuse contractors employed by Thurrock Council have a contractual obligation to return bins to the property and not leave them scattered on the pavement. What action is being taken to ensure that this is done? Has the contractor been formally warned. Has the contractor been fined ?

2. Pavement parking, Has the council ever issued a parking ticket for parking on the pavement in such a way that it blocks pedestrian access? Is the council taking any action against the number of vehicles that are parked with 4 wheels on the pavement in the homesteads area?

The information below has been supplied in response to your request for the

above mentioned information. We hope the information supplied satisfies your original request.

1. The Council's collection contractor does have an obligation to return bins to the position from where they are collected. This is generally taken to be at the back of the pavement.

The Council does monitor performance in this respect and requires the contractor to observe and comply with this requirement. Where problems are reported, inspections are carried out and this is brought to the attention of the contractor to rectify. No fines have been issued.

2. We haven't issued a penalty for a vehicle parked on the pavement in an obstructive way, without it commiting another contravention.

 

We have issued numerous penalties to vehicles 2 and 4 wheels up on the pavement on single and double yellow lines with and without chevrons. School keep clear markings also apply to the pavement as well as the carriageway. It is also an offence for a vehicle to obstruct a drop kerb outside someones drive and at pedestrian crossings where the kerb is also dropped. Though we haven't issued many for this offence.

A HGV parked anywhere in the borough on the pavement or verge is also committing an offence. We have issued many penalties for this in recent months.

 

There are no prohibitions on footway parking in the borough for private light goods vehicles, nor are there any scheduled works to introduce this in the future as far as I know.

If you are unhappy with the Council's response you can make a complaint via the

Council's complaints procedures and this will be looked into. If you are not happy with

this decision you may then appeal to the Information Commissioner.
